I-140 & I-485, denied, appealed, approved within 60days!

Hello forum-bers,

I have learnt a lot from this forum, so I am obliged to share my very interesting experience so that someone is a similar situation may know what to do. All filings were done using a very competent law firm. Here's my story:

- Filed concurently Feb 2003 @ Vermont.

- Received EAD, Advanced Parole and all others 03/2003

- 01/2004 received RFE on Company's tax returns and my W2,

- RFE request sent 02/2004

- 03/2004, I-140 was denied, I-485 was also denied, EAD that was due for renewal 04/2004 was also denied, Case officer came to the conclusion that my company coulld not pay my wages.

- On receipt of denial notices, my solicitor and I analysed the reasons for denial, we found out that the case officer wrongly adjudicated my case because W2 was wrongly interpreted and company tax returns were also wrongly interpreted.

- a robust refutal based on solid evidence was put together by my lawyer backed up with bucket loads of documents including co. financial statements, paystubs for the last 2 years, W2 for the past 3 years, CEO and CFO letters stating that the Co. is sound with CPA report and other confidential documents to show that they are wrong. This was shipped to INS. We were informed that appeals could take up to 1 yr to be reviewed.

- I also contacted my Senator as well as Congressmen in my employer's district as well as my residential district, a copy of my lawyers letter was sent to them , to request they ask the INS to review my case speedily as their inital adjudication was wrong. The Senator and Congressmen wrote to the INS askign for a review.

- on 05/2004, I-140 was approved, a week later I-485 was approved.

- Got my passport stamped on receipt of approval notice.

- Another tip, I was able to keep working after EAD was out, because of AC21

I hope this info will be useful for someone. I have learnt that things are not always the way they seem. With the INS you must be ready for the unexpected, they are not perfect, but the burden of proof is on the applicant which makes things difficult.

What an ordeal you had to go through. That was definitely a tough time for you and your family.
Congratulations on getting your GC within a year and a half, but it sure cost you a lot of nerves.

Congratulations...well there goes the saying...things happen for a reason, when you got the denial notice you must be crying but I am sure your luck was smiling at you... :)
 
If 140 is approved, have anybody heard of 485 being denied? If one is in status, and all paperwork is in place, it should be just a matter of time for the 485 approval right?
 
What a chilling and nervous moments you must have gone through!!! I am glad that you surpassed all the awful events and made it finally. Thanks to your lawyers, senator and USCIS..... Celebrate your weekend :)

BTW, are you a concurrent filer? When did you finish your FP?

I am in a similar situtation. RFE on I-140 never reached lawyer... Then I-140 got approved without replying to RFE. However, I-485 was denied for my spouse.

Can you shed light, how you were able to keep working with expired EAD.

Can you shed light, how you were able to keep working with expired EAD.

If your I-140 is approved, and you spouses I-485 has been denied, what is the status of yours ? I assume your spouse filed as your dependent. What are the grounds for your wife's denial ?

Strange things happen at UCCIS, so do not take anything for granted

I did not work with an expired EAD. I filed to continue the benefit of H-1 made possible under AC21. My ability to work after EAD expiration was based on H-1 , not expired EAD.
 
Congrats! when did you file appeal? did you file motion to reopen any chance.

My case case is denied so I’m going for appeal so I need more info on appeal and motion to reopen. Please can you post details

Appeal was filed less than 30 days after denial letter was received. Yes a motion to reopen was filed, the appeal and motion to reopen are the same.

I will suggest you file your appeal fast, preferable within 30 days .
I hope you are using a good lawyer as a heavy dose of INS etiquet is required.

Per my Lawyer, AC21 offers a number of flexibility options, as long as you are still within the H-1 6yr limit and your I-94 is still valid, Ac21 offers some form of cover. I am not a lawyer so the nitty gritty eludes me. This also includes that fact that you have not re-entered with your Advanced Parole. You may be able to revert back to H-1 after EAD expiration after proper filings with INS .
 
140 denied, went to appeals unit and back with INS???

Hi, My 140 is denied based on company finances. (May-2004). Lawyer filed for appeal and it was transfered to Appeals unit (2-weeks back). I just got case update notification email today (Jul-13-2004) saying...

"On July 8, 2004, your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received here for processing. It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete."

I don't what this means. Any idea? Do you think Appeals unit would have given favourable decision on my case. Your reply is really appreciated.....Thanks
