I-140 got stuck by security check, can I file another one?

Hi All
My I-140 (EB-1b) got stuck by security check, can I file another one in different catoglory (EB-1a)? Or the INS will hold me again?

Yesterday My lawyer recived a letter saying they are waiting for security check to be cleared.My notice date is may 12th 2005.What we should do next?
