I-140 got declined ..applied I290B.. need advise

i am posting this for my friend

My I-140 got declined and my lawyer applied for motion to reopen in the month of Jan '03. This is the status of the case when I check online.
Application Type: I290B, NOTICE OF APPEAL TO THE COMMISSIONER
Current Status:
On May 1, 2003, this case was transferred to our Administrative Appeals Office for review. That office will notify you of any further action taken on this case.
I got my 8th year extension till the end of July'04. I am not sure what to do. I can apply for one more year(9th yr), but Can I apply a NEW I-140 and I-485 based on my Labor again with the same company

If you or your company have enough documents to overcome the earlier I-140 denial, then go ahead and file new I-140/I-485 immediately. (If your ealier I-485 was not denied then your lawyer can file I-140 and connect your earlier I-485 petiton with your new I-140 petition. No need to file I-485 again.)

Waiting for appeal after Six years limit is a Waste of time and as per my earlier research, 95% of cases are getting denied again by AAO.

For your information, my case went to AAO in July 2003.
