I-140 got approved and questions on I-824

Hi there,
I filed I-140 (NIW) on April 2002 to VSC, and got approved on May 2003 after RFE.
Now I need to decide AOS or CP and hope to get valuable information from previous petitioner.

Can I file I-824 myself? my I-140 petition was based on NIW. Should I find an employer to file I-824? Please let me know.:confused:

You would need to file the I-824 only if your original choice was
485 and now you want to go to Consular Process. Check the
I-140 approval notice for this information.

If needed you can file I-824 with the help of your attorney and
not any employer.

I will file I-824 with my lawyer. I have one more question here.

During CP, at which stage do I need to provide current employment information? If asked, I should be on the permanent position. Please let me know. I appreciate your answer in advance.

An individual needs notarized employment letter in the last phase of CP processing. This happens when your packet 3 has been sent to the US consulate in the individual's home country and the US consulate has sent you a request to appear for the final interview.

The employment letter should mention (More importantly) that your sponsor will hire you after you get your Green Card. If you are currently working with the same company, the employment letter should also mention that also.

There is a couple of sample employment letters onthis forum. Just dig in to find that best suites your situation/interest.

Do as cpDelhi has suggested. But take the employment letter
only about 1 month before your interview date.

The point is it should not be too old when carried to the consulate.

I am negotiating my new job. I am wondering if I need to get an employment letter with a permanent position offer. Again my I-140 was approved based on NIW. I appreciate your answer in advance.

I am not really sure how dependent the NIW category people
are on a job. However if you are in the process of getting a new
job the initial offer letter you get from them can be different from the Employment Verification Letter that you would carry to your
interview.

I-824 filing

Hey Chong,

Do you have an EAD or a valid working visa ? You may be asked a few questions as far as if you used the AOS just to get the EAD.

I am thinking of filing I-824 instead of AOS. When I filed I-140, I asked for AOS.
do you think I can use AOS just to get a EAD? let me know.
