I-140 from two different employers

Hi Gurus,

Company A, where i have been working for the past 21 months, is filing for i-140 after perm labor approved in Oct 2006 under EB2 category. Company B, who i have been talking to regarding future employment, has also got my labor cleared in Dec 06 under EB3 category. Now, company A is filing for my i-140 soon and company B also wants to do the same. I will be joining company B for whereas reasons in a couple of months. Here is my question:

- Is it technically possible for two different employers to file for 1-140 at the same time for the same candidate?. Is there any adverse repercussion by doing this?. Pl clarify
 
Yes, it is allowed. No problems unless companies don't know about the other case or don't mind if knew.
 
Technically it is possible. As psv007 said if they of each other and dont mind. But you will eventually have to decide which company you wanna keep. As one is EB2 and other is EB3. You will have to decide eventually which is more beneficial for you.
 
Need your advise on I-140 with 2 different companies

Hi Guys
I am currently working for Company A. My labor certification was filled by this company in 2001. The labor certification was remanded in 2004. Company B sponsored me as prospective employee and filled LC in 2004. The LC of Company B got approved in 2006 and I-140 has been filled by company B in the same year (pending for approval). Now all of sudden, my LC with company A has been certified ( He is still working with company A since 2001). Now he wants to file I-140 & I-485 with company A. I spoke with immigration lawyer of company A and Lawyer told his that he does not have any problem in filling I-140 but It need to be mentioned during I-140 filling that you have a pending I-140 with company B and I may get query since I have pending I-140 application with company B. The chance of query are less if he can withdraw I-140 application with company B and then file I-140 with company A. I am in a state of Dilemma whether he should withdraw I-140 application from company B or not. The reason is that I may also get query after withdrawing application asking him reason to file and withdraw I-140 application with company B. Also backup plan with company b will be lost. Any advise would be appreciated.

Risk for second I140

Hey,

What is a risk when someone files a second I-140 with different company and I-140 from first company is approved.

In section 4 of I-140 Question 6 ask if there is any other immigration petition filed for the this person.?

What happens to my I-140 if for any reason 2nd one gets denied.
