Long story short: Labor certificate approval came in 2006, priority date is August 2005. I filed for EB2 a couple months later. Denied! Refiled for EB3 in March 2007 on the same processing center, Nebraska. Premium processing was denied under the grounds that this was a Labor Certificate Substitution.
This is not a LABOR CERTIFICATE SUBSTITUTION!!!! I am the beneficiary stated in the LC, and I am the one refiling I-140.
What does that mean? Why would they call this a labor certificate substitution?
Has anyone experience this before? I was told PP was available if refiling I-140 in the same processing center. Should I try and still pursue PP?
