In the same boat

My I-140/I-485 has been denied on Jan 14th'2005 stating that there is no labor approval My Labor certificate was lost in the mail). My Attorney submitted MTR on Jan 27th with Final Determination Letter obtained from DOL. The estimated time was between 30 and 180 days and since it is nearing completion, I have approached the senator.
He came back with a reply stating that " the officer has requested "NON-USCIS Opinion" in relation to the I-140 petition. It appears that we need to contact USDOL concerning a labor certification issue. The application is pending with the clerical here and once the outside agency response is received, this matter will receive further review".

Can somebody explain who could be "NON-USCIS" / outside agency?

HI Friends,

Any body is still waiting like me for I-140. EB3. since Jun 2003...

Please help me.. what action I need to take.

I think they are wating for ur labor approval copy

Sanju,

I think, they requested labor approval copy from DOL.They are waiting for that.Normally it will take 6 months to get labor copy from DOL,sometimes it could take many years. They will request many times,if employer copy of labor is folded, wrinkles or color shaded or is not under good condition.

One of my friend also got same response. But,for him it took one year to get approval. So,USCIS don;y have any control on this.

Better expediate request from senator or congressman by writing letter to them about your situtation.

This is my 2 cents.
