My Labor Cert. has been certified on July 2007 and I-140 & I-485, EAD & AP has been submit concurrently on July 2007 with EB2. EAD & AP has been approved. My labor cert. states minimum education required is Master degree and no require experience for the job. I have a master degree which is related with the Labor cert job title and job duties.
I start working with my company on July 2004 with a Bachelor degree and completed my Master degree on May 2005. I do not have any work experience before. Do I qualified for EB2 ?
My Attorney told me that IO will notice when my company hired me I only have a Bachelor degree not a Master degree and I am no qualify for the EB2 and they would deny my EB2.
Please advise if I should refill the EB3?
