Hi guys my I-140 was denied for ability to pay by my company this is a small company sole ownership it has been in buseness for 55 years it made net profit of 20,000 in 2000. My lawayer is appealing the decision. What would be my next step, is it ok to apply as non-rir. Please I need your advise

Your company paid the salary as specified in the LC?. No bench and no problem with your W-2s in last two years?. If every thing is alright, then your lawyer's appeal may work on the argument that the comapany is able to pay. Please let's know on size of the company and yearly turnover, if possible.

This is a small business with a turnover of 500,000 my LC was in EB3 catagory. My I-140 was filed in April, 2002 and received RFE in August it was responded to in Sept. I did not here from them until i filed I-485 in january using the concurrent filing. The pay on my pay stubs is a bit lower than what is on the LC as as my employer told me that he will pay me that amount when am approved.
