I-140 denied - MTR Pending - H1 extension

I-140 along with 485 got denied. 2 reasons for denial, education and ability to pay. Motion to reconsider has been filed on 10/22/08 still pending. My H1 (6 yrs) expires by end of March 2009. Regarding H1 extension my attorney suggesting to wait until 2nd week of March.

I’m worried, as at the neck of the movement if MTR fails then I have no option right? Please advice!

my advise is, dont take chances...go ahead and file an extension...do premium processing...im on the same boat and waiting for MTR to be filed..
