I-140 denied, approved 7th year will be affected ?

Hi Friends,
I have a bad news, My I-140 is denied based on ability to pay.
My lawer says that its no point to appeal for this case.

While I got I-140 RFE from Company A, I got my 7th year H1B "APPROVED" from Company B.

My Question is:
As my I-140 is denied, will it my 7th year of H1 will be legal / in effect.
So can I legally stay in USA and work legally in USA till end date specified in I-97 (notice of approval/action - H1B 7th year approval letter) ?????

Yes, My 7th year H1B is already APPROVE.
So, even my I-140 is denied, I will be able to stay & work in USA legally till end date specified in I-97

You're right ! Once it is Approved, It will be valid until expiration date on that notice.

i filed labor sub in july 2007 using a 2002 pd. lawyer said approval chances are 50-50 because 2002 and 2003 employers tax returns and nett assets are not enuff to support ability to pay, however all future years are good..company has been around from 1995. i had to leave my old job and moved here in april 2007...
