I-140 Denial


My I-140 (EB2) and than motion to reconsider was denied last year because Education Qual. was not equal to US Bechelor degree. AFter that, last march 02 my attorny appealed the case

When I check my status it used to say "We have send this case to Administrative Appeal Office. That Office will inform you of any decision taken on this case"

Today when I checked it says "we have recd. this case back from administrative appeal office. if any action is appropiate, we will notify when it is taken"

Could you anyone let me know what this message mean.
I mean Denial/Still Pending/Approval

1) Was your I-140 denied because the INS did not accept your eval that said your education is equivalent to a BS degree in the US

OR

2) Did the eval you got done said that your education is NOT equivalent to a 4 year degree?

I think the message you see is just that they will get back to you when a decision is made. I hear the appeal takes almost a year.

Usually, AAO used to make a decision but
I am wondering why the AAO didn't made a decision, what they sent file back to VSC.
 
Interesting. Was all your eval based on education only OR education + experience. Did the INS explicitly say "that we do not agree with the eval" because the evaluator is not recognized or something.

This the AEC say that they will accept an equivalent degree?

It is my feeling that it may work out for you with an appeal (cross my fingers).
