I-140 Denial without RFEs?

Any information on cases that got denied without receiving RFEs?

Or does BCIS first issue RFEs before denying a case?

My case is still pending without RFEs and just curious if there has been instances of such cases.

First RFE..usually...

HI,
As far as i know,usually BCIS issues RFE,and after they receive the reply evidence for the RFE,if still unsatisfied by the evidence,BCIS issues a long form RFE,giving 14 days to reply(i guess AM NOT SURE),then the denials.
So DO NOT WORRY at this stage about the denial,the name of this game is P A T I E N C E!!!:)

I once saw a case which read the case status receipt message and later on changed to "our last written decision on this case has been sent on. . ." which of course means a denial, and without RFE messages in between those status change.

I guess maybe they have not updated the AVM between the status changes.

Hoping for the best and good luck on your pending cases.
 
Dont worry guys,

From whatever data we have collected we can see that the non concurrant seems to be a bit slower that the concurrent filers.

only 3 out of the 7 people in Jan/Feb who have non-concurrant have gotten approved.

So wait a bit more(a month), i am sure it is your turn.
You are not alone. :)

maybe you can talk to saryn,ajahanpanah and xgc who seem to have approvals. those who dont are, ipc302, rvalla,swann and shya.

I refiled my 140 on Feb 12, 2003. Rakeshr, could you please post why you had to refile the 140?

Mine was due to company restructuring......i have posted the details earlier....

According to INS my LC did not match with my qualification.
LC required 4 yrs degree & 5 yrs experience.

Earlier it was EB2/RIR but refiled in EB3/RIR Category.

I had educ. evaluation saying my 3 yrs degree + 7 yrs experience = US B.S.

I have refiled my I-140 again with new education evaluation saying 3 yrs degree + 2 yrs NIIT diploma is equal to US BS degree.

Its 8 months since I filed my I-140 and still there is no decision on my case.

Hi,

My I-140 got approved.

RD date Feb 08
EB3/RIR/CP
LIN: 03-102-5****
Approved on June 2nd.

Came to know about it only yesterday. I had a problem with the
wrong filing fee for I-140 and had two LIN numbers. I was checking one, while it was the other that was approved. Please
refer to my older postings for more info on this.
