Sorry to post this here..I did not get much response from I-140 forum...PLEASE HELP ME OUT

All,

If any one who had -140 denials can post their details, it will be of great help to the people going through the same phase.

Please post details like, reason of denial, approach you took etc.

I think you are filing under NIW (National Interest Waiver), if so it could be
1. insufficient evidence
2. Officer thinks your case is not eligible.

The way I dealt was. happened in 1997, I coughed up another 1000 dollars to the dead-beat lawyer by appealing in the immigration courts and got denied again after 8 months.

Details:
I was working as a contractor for DOL. They gave approval for couple of colleages but denied my petition.

Anyway now I applied in EB2 regular on 09/01/1998 and filed 485 six months ago.

Hi Eyeoneforty,

I applied labor in EB2/RIR category and got labor approved.
I filed I-140 and got a RFE that "Do we want to continue in EB2"
I have three years degree and seven years of experience.

Attorney replied that we will change it to EB3.
Last week INS has sent a mail that I-140 petition has been denied.
The petition required a US Bachelors of Science (4 yrs) or foreign
equivalent and five years of experience.
