I-140 Denial (any similar cases) lawyers help..

hello Friends,

My case is :
EB2 (I have US masters )
I am on 6th year h-1 B(expiring Jan 2009)
Got my EAD/finger printing/Advanced payroll last year(Nov)

My company and lawyer are reluctant to share any info regarding I 140 stating that its company's matter and has nothing to do with me.
I was informed that my I-140 is denied (reason lack of supporting documents).
Lawyer says we have pretty good chance as he has reciept of mail through which he sent supporting documents.

I understand there are two options;
1. MTR and second is appeal.
I read that in forum that it really takes long time .
Do any body know what are chances with both and if I can keep my
PD and I 485.

2. I have not filed any h-1 b extention...will I have to leave country if my case is denied?
3.Can i keep working in U.S. if my case is pending beyond Jan 2009.
4. Most importantly..is that possible that my employer and lawyer are lying to me.and this is just a trick to keep me working for them for longer time..is there any way I can check this my self(I have lin # for Labor)

5. I am told there are many such cases happening with I 140 is denied without any inquiry and lack of supporting doc is most common one.
any body out there with similar case please respond.

You can extend your H1 based on the pending appeal. If you don't trust your employer, find a new job. Its difficult to do this process if your employer is working against you.
