I-140 - Can my Company Keep it ?

Hi Rajiv,

I am hoping someone at the Rajiv Khanna office will be able to explain this to me. I have an approved LCA and I140. After reading your threads, I see that I am able to move to a new company and keep my Priority date if I have an approved I140.

Unfortunately, my current company is holding on to my I140 and is refusing to release it.

1. It there any law preventing them from releasing it ? If not, what can I do to obtain it from them ?

They are also not currently paying for my green card process. They have filled my LCA and I140 and I have to pay for my own green card process once the priority date reaches the time.

2. Can I use that as leverage to obtain my I140 ?


Please advice.

------------- I-140 belongs to employer it is NOT your petition it was filed for you. employer or his lawyer may not give give you the approved I-140
If not, what can I do to obtain it from them ?
