I-140 CALIFORNIA EB2 Tracker only

My case is a mess.

I filed concurrently using my wife's I-140 WAC032155XXXX. The approved my I-140 is an independent one.

My wife's I-140 is still waiting for approve. On November 26, 2004, they mailed a notice requesting additional evidence or information in this case. We are still waiting for this notice.

My wife's I-140 WAC032155XXXX used a substitute lab. We queried them around Octomber this year and figured out that they cannot locate the original lab. We sent another original substitute lab to them. We asked CA senator to send inquery to push our case, etc. The LUD for WAC032155XXXX has changed more than 10 times. But for my I-140, it was changed only two times.

Hi 008,

Check with your lawyer about 140 RFE.
My online status shows I got RFE for 485 and my lawyer got 140 RFE and should reply within 30 days. Its kind of strange.

According to online status, they mailed out RFE on November 26, 2004. Since the lawyer didn't receive it, he required them to send another one. I can see that they touched the case again on 12/10/2004. I am really confused about how things work in USCIS.

Now after the lawyer of my wife knew that my I-140 has been approved, he suggested us providing USCIS a copy of my I-140 approval notice and a current employment verification letter from my employer for a possible combination with previous filled I-485. I am not sure how it works.

I-140 Approved

My I-140 has been approved on 12/15/04. I got the email from USCIS yesterday & waiting for apporval papers to arrive my mail.

EB3-Concurrent Filing
I-140 RD 4/29/04, ND 5/3/2004, AD 12/15/04 (No RFE's)
I-485 RD 4/29/04, ND 5/3/2004, FP 06/03/04 done, AD ??/??/????

LUD update on I-485 on 12/13/04 looks like somekind of mass update but the contents in the case remains the same.
 
Ability to pay

Hi Gurus,

We hear scary stories of the RFE being issued to ensure the company's ability to pay. Are there a certain guidelines, the USCIS follows towards this?

My company employs 300+ people and has been profitable over the decades. It is a part of a countrywide corporation with about 2000 employees. Due to the business down turn, they incurred loss, (though not high), only during the past two years. Will that prompt the RFE being issued? Are there similar situations? Please share your thoughts/experiences. Thanks in advance.

update

The lawyer spoke directly with the officer handling this I-140 petition today. The officer said that there is not an RFE for this I-140 and that it is a mistake that the computer says that there is an RFE. Instead, he is working on this I-140 and hopes to have it completed/approved very soon!

How did your lawyer contact the officer? I am in a similar situation.

I 140 RD 09/08/03
I 485 RD 10/02/03
FP 04/10/04
LUD for I 140 : 12/15/04
it says request for further evidence. We haven't received any mails from them till today.

my lawyers have already done the inquiry twice and 30 days have passed since 2nd inquiry.

I am not sure the details. But the lawyer managed to speak to the office handling our cases directly.

On December 27, 2004, the document we made based on the approval or
registration of this case was mailed directly to the person to whom
issued.
 
I received the same information today for my previous approved I140 case (WAC04107xxxxx, approved on 12/15/2004). Check with your lawyer to see if they received the approved notice already.

In that case it is for the RFE which was sent by the department on 12/13/2004. I was just wondering what do they mean by approved or registered.

Hi, I got RFE, replied and the msg says

"On January 3, 2005, we received your response to our request for evidence or information. It is taking between 360 and 360 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case."

What does this mean? Are they OK with the RFE reply/need more?

The lawyer talked with the office again yesterday. The office said that he/she is making progress. The case is being touched again today. Don't know what they are doing.

No RFEs. If I recall correctly there was an LUD on the I-485 on 10/27/2004. No LUD on the I-140. My fingerprinting was done on 4/17/2004.

Also important to note that my wife's I140 (totally independent application) which has an RD 12/15/2003 (mine was 12/30/2003) was approved on 1/18/2005 (a couple of days before mine). So that tells me that for the vast majority of I-140 they are now processing middle of Dec 2003 to Jan first week 2004.

Only I-485 LUD changed on 10/27/04 and 01/10/05
No LUD updated for I-140.

But still waiting for approval.

Thanks. Kabish, remember that my I-140 has a RD of 12/30/2003, three months before yours. So it might be a while before they get to March 26 2004 I140s.
