I-140 Approved
Finally a big relief ..after long wait..my I-140 got approved after 2 RFEs'
Nebraska/RIR/EB2/Concurrent
ND 8/27/03
1st RFE 3/12/04- W2, paychecks, company financials
2nd RFE 3/29/04- more details on company financials
2nd RFE received on May 12th 2004 and Approved on May 28th 2004.
I485 Fingerprinted 5/15/04, received by USCIS/Nebraska on May28th.

My company didnot give the details of what exactly they asked in both the RFE's
but I understand from what lawyer said..is that in 1st rfe they asked w2, paychecks, and financial documents that show company's ability to pay.
and in 2nd rfe they asked for more documents on financials.. may be the officer has an accounting background and he wanted more details on company's financials..or my company didnot provided sufficient info. in 1st rfe..(but company said they have provided what they asked)

i saw the rfe . pretty extensive . they also want proof of the salary they paid the previous person and proof that he quit the job . i get a paid a lil more more than the previous person. am worried if that will be a negative thing . also what documents to provide to show what they paid the previous person and to show that he quit?

1>What is the order of approval between EAD,140 and AP.
Is it necessary to get I-140 approved to get EAD. How much time on an average it takes for I-140 at NSC.
2>Once we get I-140 approved is it safe to switch from H1b to EAD ?
What is the chances of ones I-140 or 485 not getting approved.

1. No orders between EAD/140/AP and 140 approval is not required to get EAD/AP. 140 takes between 4 months to 1 year.
2. Its better to keep H1b status because if 140/485 denied u will still on H1b, but if you use EAD then u need to file a new H1b. Once ur 140 is approved and 485 is pending more than 180 days then u can use AC21 portability to switch the employer.
There are more reasons for INS to deny the application. You can check with ur attorny or some experts.

Hi Iyrao
HOw do you know your Finger Printing is received by INS. I did my fingerprinting in April 2004. I didn't hear anything from INS. My EAD renewal in Dec 2004 does not have my fingerprints yet.
