Today I got mail saying that my I140 approved.

Case history:
140/485/131/765 (EB2/con): 09/01/2004

131, 765 AD: 10/16/2004
140 RFE1: Some time in November
140 RFE2: 11/30/2004 replied on 12/29/2004, approved on 01/13/2004

Still waiting for FP.

Can you share more info on what your RFE asked for? I also had a 140 RFE which we responed on almost the same day as you. No updates since then.

Hi xqg,
"The ETA was accepted on 2001. The form ETA 750 lists the required education as a Master's Degree or foreign equivalent in CS/CE/Industrial/CA/EE or related field. The record shows that the beneficiary has a Master's Degree in xxxxxx. The record does not show that the beneficiary has a degree in a qualifying field.

The beneficiary is not clearly eligible for classification under this section. Therefore, the petitioner is afforded thirty days from the date of this notice to submit additional information, evidence or arguments to support the petition. Failure to respond to this request will result in the denial of the petition."

Thanks bucs2004. My RFE was about company's ability to pay, the harder one in general.

Hope soon you'll see your 485 approval.

Did you receive any LUD between 12/29/04 and 01/13/04? I just got LUD on 01/04/05. I-140 RD is 07/14/04 (EB3).
 
Are you guys use substitute labor or own labor?

Hi,
Any of you guys use substitute labor ?
Just wondering if the delay is only in substitute cases :confused:
