Friends,

Here are my case details. I need your advice for my next steps.

I-140/485 filed concurrently 1 year back.
After 6 months of pending I changed employers. Since my ex-employer threatened to withdraw I-140, I didnot take risk of moving jobs on EAD.
So I had my H1 transferred. Now my I-140 got approved.
Can I send in the AC21 letter now and keep the process going ?
My current lawyer said that transferring my H1 would automatically void my GC processing with the old employer. Is that true ?

Please advice.

Thank You.

------- yes, inform the USCIS and invoke AC21, send your new employer letter with same/similar permanent job offer after I-485 approval(better also attach copy of 3-4 recent pay stubs through new employer)+copy of I-485 reciept and on cover letter write that your intent has changed and make a request that you want to use AC21
My current lawyer said that transferring my H1 would automatically void my GC processing with the old employer. Is that true ?
----- your Lawyer is wrong. he does not seem to know the basic of GC, GC is for future job, H1 is diffrent petition AND I-140, I-485 are diffrent petitions. one can be working with A on H1 and GC CAN be filed by B
Please advice.

Thank You.
___ it seems that you asked the lawyer of Past employer :D

Ginnu,

What if my I-485 gets approved before my AC21 papers reach INS...
(in some cases which were similar to mine, I-485 got approved within a week after I-140) ??

I believe there is no rule stating that I have to go back and work for my ex-employer because my GC is for future employment with that employer. Is this true ?

Thank You.
