It was indeed a Good Friday. Another battle won!

My sincere thanks to UN, who helped me in my 140 approval,
after all my applications (140,485,485 for my wife) has been denied (Ability to pay).

This is the story

My 140 and 485's were filed concurrently in July 7 2003 (EB3).

I didn't see any changes in my case until I got my finger printing in Sep 1 2004.

On Dec 2 2004 my status in 140 read " The last notice sent was returned as undeliverable, please update the address.....)

My 6-year stay was about to end by Feb 9th 2005. And we applied for 7th year extension
by premium processing.

I called my employer to change the company address but they didn't care.

By Dec 15th I called the USCIS to update the employers new address.

In the mean time I got 485 denial notices for myself and my wife stating since 140 has been denied, 485 applications are denied as well.

Finally my employer received the 140 denial and H1B denial notices on Dec 21 stating that we can appeal the case by Dec 25.

I got only three days to appeal and I couldn't find any immigration lawyer.
(My company applied the 140 themselves without the attorney in the first place. That’s a different story)

I found one lawyer to take my case. We sent the 290B notice of appeal for 140
stating we will send the further evidence in 30 days.

Here comes UN to play..

I called UN and told the whole situation and I want him to do the write up for me.

He gladly accepted and again it was really big pain to get all the documents from
my employer (it took 20 days to get the documents).

My priority date for labor is Nov 27 2001. 140 was denied stating that my employer
doesn't have the ability to pay in the year 2001 ($9000 was his profit according to his tax filing).
UN said based on receivables we could show more income but my employer never kept track of any bills or document to prove that.
Based on prorate calculations UN documented a foolproof explanation with lots of quotes " Yates memo " and previous approvals based on prorate calculations.
But still UN wanted to include some evidence for the cash receivable for the year 2001 which my company received on 2002.

My H1B got approved on Jan 11 2005 based on 140 appeal and I was little bit relieved.

My lawyer told that she is going to file the evidence on Jan 20th no matter whether she receives the cash receivable evidence or not.

Until Jan 20th 5pm my employer haven't sent any evidence. My lawyer called me and said she has sent the documents to INS. Within a minute my employer called me and said he has just faxed the evidence to my lawyer.
I was trying to contact my lawyer but they are gone for the day.
Another sleepless night thinking that all our efforts is going to be in vain.
I called my lawyer next day and she told me she got the evidence and she is sending the final draft from UN with all the evidence.

UN told me my case would be approved 100% without a doubt.

March 17th I called USCIS to make a case enquiry on 290B. They said I would come to know in 2 to 3 weeks of time.

March 24th there was a status change in my 140 " Your case was reopened by BCIS motion and it is taking between 90 and 485 days.....")

I called UN and asking what is time frame for approval after reopening the case, he was confident and predicted my case will be approved in one or two days.

He is a prodigy!

He called me this morning and told me my case was approved!

I checked my email, Bingo! there it is...the magic emails...

I hope to get my approvals on 485 very soon too..

Are you going to give him any gift?!? :)

Anyway, Desi employer take a ride on us under paid, no help or whatsoever on the GC process. USCIS should understand all this problem and process our case soon. Yes, we can see some improvemnet on GC process as far Labour concern but I140 and 485 they are ll very slow.

Once labour is approved they should approve the 140 with in 30 days. After that we can work for any company. This would eliminate all the pain and mental agony we are all going through...

Anyway, people like UN, Jharkhandi and so many are ready to help fellow desi...

I would like to request a one thing to all desi's that, If you strat a company and employee our desi, Please don't take a ride on them.

Is it MTR or Appeal success?

Congratulations!

I think without UN in this forum many of us might never know what this problem really is and how to overcome it. Without him, we would have to listen to what attorneys and employers had to say about the issue. Almost in all the cases in the forum, the attorneys and employers were very much skeptical about the success in the RFE/MTR/Appeal after getting this problem.

Unitednations really made us so educative about this issue and led us in the right direction. No words to appreciate his work.

Can you elaborate on the LUDs and message changes on MTR and I-290B?

We (4 candidates from same company got denied in bulk) also sent in MTR and appeal(I-290B) after ammending tax reuturns with the help of UN. They did not consider MTR in our cases but sent the cases to AAU.

Is your case also transferred to Appeals and then you got a decission from Appeal? Present Appeals timeline for EB3 says almost 14 months.

We are thinking of re-applying I140/485 instead of wating for such a long time in appeals. But after reading your success story I have to think twice.

Please give us further details. This really help us chalking out whether we really need to consider re-apply instead of wating for appeals decission.

I hope you would get approved on your I485 soon.

Congratulations on your 485 approval.

Could you please give us the details of your I290B LUDs and status changes. We are thinking of re-applying our 140/485's which are in appeals.
Is your success through Appeal or MTR?

My 290B was received by USCIS in Jan 3rd ( That was their message "We received your appliaction on Jan 3rd and its taking between 60 to 180 days....)

I called the cust serv # on March 17 asking for the status. ( This was UN's idea ) The rep told that they are processing cases received on Jan 17th and she said I might come to know some kind of decision in 3 to 4 weeks.
On March 24, the status on my 140 changes stating " Your case has been reopend in BCIS Motion and its taking between 90 and 360 days to process this kind of case......)

I spoke to UN that day and he predicted that my case would be approved in one or two days.
On March 25, as UN predicted, my 140 was approved. Same day my 485 was also reopened and got the approval yesterday.

I290B messages on my file

Thanks for your reply. When we sent in MTR/Appeal in January, initially the messages said that they received the MTR/Appeal requests. But after 3 weeks, the messages are saying as follows: Is it the same in your case too? I mean initially service center's recieved messages and later changed as received in Commissioner's office as follows.

Now our worry is whether Appeals are really taking 14 months for EB3 cases or not. If it is, then we are planning to re-apply.

Your approval gave us fresh lease of life. Could you please verify the messages with your earlier/present messages?

I will appreciate your time and help.

Now my I-140 message says:
On February 22, 2005, your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received here for processing. It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

and my I290B message says:

On February 22, 2005, your I290B NOTICE OF APPEAL TO THE COMMISSIONER was received here for processing. It is taking between 30 and 180 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

How can you identify mainb04 case was not transferred to appeals at all?

Its really great to have people like United Nations on the forum. I never seen a person in US, who is willing to spare valuable time and helping people.

I also talked to United nations and got good advices during my typical situations and my 140 has been approved.Please see my posting in CSC.
