Congrats Salini! This should be a great time for some relief..
When you said mistakenly filed in EB3..did NSC make a mistake or the lawyer made a mistake? How did you get your FP notices if its EB3? Did you let it process in EB3

I am in a situation where my lawyer filed my 140/485/EAD/AP in EB-2 while NSC sent a receipt notice back for only 140 as EB3..Since I was hoping to get EAD for my wife, I requested my lawyer to have it corrected but got no response from NSC since a month..

My lawyer filed my I-140 mistakenly as EB3. After receiving the notice, lawyer and I both found the problem and my lawyer wrote a letter to USCIS to correct it. There was no response from USCIS even after letter and phone calls. I will have to wait till my lawyer or employer receives the approval notice of I-140 to figure out approval as EB2/EB3.

I recd first FP on 1/12/05. Recd another FP with code 2 Biometrics on 5/12/05.
