I 140 approved after RFE

Hi all

My I 140 was approved yesterday

ND - 03/19/03
RFE - 05/5/03
RFE RD - 05/19/03
AD - 06/30/03

After RFE(requesting experience letter which was included earlier too) and I -140 approval, do any one have an idea when EAD and AP will be adjudicated.

My wife is traveling by the mid of July. Eventhough she has a valid H4, the new one is not stamped in the passport. Can she come back without stamping it as her EAD is anytime due for approval.

Status of her EAD does not matter. It is AP that allows her to enter US without Visa. If she has approved AP she can come back on that. She needs original copy of AP.

People prefer H4 on AP if she is not using EAD.

Congratulations on your petition approval.

I was on the same boat , but waiting response from BCIS on my I-140 petition. They kept hold on EAD/AP because of RFE's on I-140!!

RFE -04/25/03 (Category issue)
RFE Response received- 05/13/2003
AD - ?

Waiting .................

God only knows when will they respond. Called BCIS national call center, they jusy go by book rules and says it is about 13 months for I-140 processing times and they can't contact service center about the status of my petition because it is noy yet 13 months...

My I-140 was approved after RFE on 6/25/03.
After that my EAD was approved on 6/27/03.
Then my wife's EAD was approved on 6/30/03.

I am waiting for last 1.5 months about on I-140 case (RFE for category). Online status shows that 360- days, but initial processing done and it takes less than the maximum time mentioned. But no signs of approval yet?

My EAD on hold because of I140 and RFE notice says that call BCIS in 60 days if you not heard anything, I'm waiting for 60 days to complete from my RFE responded date and want to ask attorney to send a letter about the status. BCIS customer line says that 13 months has to be passed then only they query to service center. Thats bottom line.

by the way , one question

Did they mentioned the same information on your RFE that 'call BCIS in 60 days incase if you not heard anything from them' ?

I saw you mentioned somewhere in forum , they kept hold on your EAD because of your RFE on I-140, but they didnt mention anything about my EAD in my I-140 RFE !! but service center officer told me in may that they held my EAD because of pending I1-40 !!! very strange

Its a new rule to put EAD on hold when there is an RFE issued on the I 140. Anyway, hang in there, you should be next.
