My I-140 EB-3 finally was approved 2 days ago. Received e-mails today in the morning.
LC PD Apr-2001
LC to regional Dec-2001
LC remanded to state Mar-2003
LC approved Jan-2004
I-140/I-485 filled concurently 11-Mar-2004
RFE I-140 (ability to pay, education, company info etc.) 1-Dec-2004
RFE I-485 (tax returns, W2 etc.) 1-Dec-2004
both RFE replied 23-Feb-2005
I-140 approved 7-Mar-2005
I-485 pending

Ability to pay?

How many consultants working for your company and Turn over. I got the same RFE and answered yesterday.
Mine is 70 and app 10 Mil turnover. My W2 for 2002 is very less and 2003 and 2004 are OK?
Do u think it will be OK or any problem?

Today all I-485 for me, my wife and daughter were approved. That was fast!!!

For I-140 RFE they asked:
- Form DE-6 Quaterly wage report, from EDD for the last 4 quarters, sealed
- Education and training, copy of BS degree and transcript (they asked for copies, not the originals)
- evaluation of education
- proof of successor of interest, the company changed the name 2 years ago
- proof of ability to pay,
- copy of LC

For I-485
- proof of status, (I-539 notice)
- employment verification letter
- tax returns (IRS copies) for last 4 years with W2

So it was a long list of papers to collect. It took me and especially the company 2 months to get. That was starnge as half of the docs were a part of the original submition like LC, copies of diploma, transcript. The case wasn't labor substitution and all these years I worked for the same company (40-50 people).

Anyway it is over now. Good luck to all you guys. Sooner or later everybody will get it.

How long did it take to receive RFE?

On email, it says that RFE issued on 3/4/05. I have not received a letter yet.
Anybody gives me experience.

Could you please tell us what was your graduation on?
It would be helpfull to know the LC requirement too.
