I-140 Approved after RFE response. No change in I-485 !!

Hi,

My I-140 was approved on 01/06/2005 ( RD - 04/05/2004 ) after getting an RFE. The RFE was about the filing category ( EB2 or EB3 ). My lawyer sent the response on the same day and CIS received it on 12/28/2004.

But it is surprising that eventhough the filing was concurrent, they have not approved our I-485s. I think the concurrent processing is no longer in practise. Any inputs on the topic ?

Hope we all get our GCs soon !!!

Yes it does appear nowadays they are not approving both in concurrent filing. My 140 was approved almost 2 months ago, no sign of 485 changes. Congressman's inquiry stated that name check is pending since Sep 2003. So until your name check gets cleared the wait is on.
 
Hi Waiting_4GC,

Did you get email saying that your case approved? or letter to the lawyer? any LUD changes for 140 other than RFE received?

Hi bucs2004,

I received an e-mail from USCIS saying that my case hase been approved. The LUD on 140 changed when they received the RFE response and then for the approval.

I have seen people getting I-485 approval after a few days. So, hang on, you will get approved soon as your RD is almost close to the current processing date.

Is your PD current?

Guys,

One and half month back my 140 was approved after RFE. I waited for 10 days for my 485 and after that I enquired about my case thru 1800 and emergency no. Till today I have not received any reply from USCIS.
Do I need to wait more time to get the appproval.

This guy received his I-140 approval on 29th Dec and received I-485 approval on 5th Jan 2005.

The trend here seems like whoever applied after/on 03/04 are getting their 485 approved in some days.
That does not look like its happening to older cases of 2003/2002.
One can never know how USCIS works. :confused:

Does it mean my name check is cleared...?

My Priority Date is 11/2001

Mine is filed in EB3 category.

Yours is a very long journey.

Probably your RFE had a taken lot of time. Since it is approved, hopefully you will get your I-48 approval very soon.

Have you done your FP yet?
 
I don't think that means that your name check has cleared.
I have the same status "On Dec 30,2004, we responded to your request for more information concerning your case". What that means is that your lawyer or someone has done an inquiry on your behalf and they have sent some information back.
In my case they sent something like this - "This case is undergoing detailed review. Please allow sufficient time for processing. "
Only UCSIC gods know what that means.
 
Did you recently enquire USCIS about your case?

This kind of message usually appear if a case inquiry is made.

I don't know the answer for that. But I guess its cleared. Otherwise, it would show that 'FP results are pending review blah, blah, blah, blah, ..'

No. It does not mean your name check has cleared. All it means is that they got a result of your Figerprint check from FBI, which typically takes less than 2 days after your fingerprinting is done. The name check is still pending. There are 2 types of checks done by USCIS, FP check and name check.

Can you please post the FBI email address to get the name check status.I remember seeing it somewhere in the posts. Can I send mine and the spouse details in the same email. Also let me know the details that I need to send in the email.

I think it takes about 20 days for them to reply to an inquiry, thats what happened in my case, my lawyer did an email inquiry on 12/09 and she got a response to that on 12/30
