I-140 and 485

can anyboby tell me that how long you can wait after LC approval to file I140 and 485, my case
eb2 certified
waiting to bring my wife here so that i can include her, your ans will be greatly appreciated

Syed2 dude,

Please post your complete case history (date of filing etc) so one could give you a better guesstimate of your labor approval dates.

Also, if I am not mistaken, concurrent filings are thing of the past. You will need to file I140 first and wait till your priority date becomes current before you can even file your I485.

I actually applied on april 27-06 got approved on may1st 2006, i just two days, I am from pak.. and priority dates are current for pak, i blv i can file concurently.. Just wanted to know how much time do i have in b/w perm and 140-485 to file it

Please take a look on this and let me know when this will finally end for me. I work for my company for the past 7 years (last 6 on H1B). The atmosphere in my work is terrible as I am so close to quit it cuz I can't take it anymore.
My question for you guys is if I quit can they call anybody from USCIS and cancel or withdraw previously filed I-140? What are the chances of doing it so?

EAD RD 03/31/06 ND 04/09/06 AD 04/21/2006 Got my EAD on 04/28/06

if you have already file 1485 and it is in lud, and its becomming very impo to change the job for you, then go ahead and do it as far as i know my lawyer has said that if ur 485 is being filed and its in pending then u can change the job but every thing with the new employer should be the same i mean job res.... but better consult with a lawyer

There is a memo called AC21. Do a search on this forum. If you change to job in less than 180 days from the RD of I-485, your GC can be denied if your GC is sponsored by your employer.

When Eb2-EB3 is decided ?

I want to know how I-140 can be filed . How much current salary and experience is required to file I-140 in EB2.

I have BS + 20 years experience .My labor is approved as engineer and salary 42K as of 2002.

EB2 or EB3 is decided by ur lc, if u have mentioned BS+5 years it is EB2

experience is based upon what u have mentioned in ur ETA 9089 LC, you have to show that exp in ur I140+ your salary should be equivalent or more then the prevaling wage determinition + if it is less then PW then you would have to show that ur employer is capable to pay u that salary once u get the green card
