I am doing a sample scan of 200 (I-140)cases from wac05041 to wac05062.

As per my knowledge there are around 1900 cases filed in December. I dont have all the cases in my database.

Thank you, guys for your dedication of scanning to our December filers. From the current results of scanning in November thread and our December thread, it is obvious to tell that the RFEs issued are almost half or nearly half comparing to the approvals. So yesterday, I called my attorney to inquire what the rate of approval and RFE is. He said 50 to 50. This just roughly matchs our scanning results for I-140. He also said the RFEs vary, but most of them are "Ability to pay", then education issue.

only few got those biometric notices lets say 10% at the max.
It will not affect the processing time of your case or your case wont be handled in any different way.

Reason for delayed Oct/Nov cases

As I wonder why my 11/10/2004 I-140 has no updates yet, I'd like to share some information with my fellow applications.
My lawyer just gave me a great reason why our oct/nov cases are not approved yet. She told me whenever CSC updates the JIT dates they assign the stack of applications before that date to an officer(s). Depending on the RD they work in timely order to the actual JIT date. Conclusion: when CSC releases a new JIT date, they should have finished working on all applications from the second last stack. She confirmed that CSC is truly rushing through the applications however quite often issue RFEs. When they start looking at the case they first check LC and sometimes come up with annoying RFEs. Nothing serious and quickly to address. If the lawyers act quickly CSC normally approves within days.

In case of no RFE we should give CSC time to work on the applications and refrain from calling them. The more calls they answer the less they can work on our applications.
She advised me to stay put for a couple of weeks and inquiry then.

Given the speed CSC is working I'm positive we'll receive good news very soon.
 
My LUD is probably due to address change

I was under the impression that my recent LUD on I485 and I140 (on 5/3/05) is because of the advancement of my case. Looks like the LUD is because of my report for address change.

Sent an inquiry email in Oct 04, I just gave out my personal identification and asked for the status, received response in Jan 05 with a pending status.

Send certified letters to Hooton and Hardy around 2/20/2005, using the format from this thread:



I was mostly complaining about the lengthy wait, I guess the words were too strong since I didn't get a response.

Two weeks later, sent another letter by Fedex to Hardy, using the format from this thread:

As you can see, the words were much softer, but I didn't get a response either.

On 3/24/05, I sent a letter to Jonathan I. Solomon, Executive Assistant Director, Administration, FBI, Supposedly Hooton's boss. This time, I was trying to be both firm yet polite. I basically stated the fact that I had been waiting for >20 months while 98% of the name check got completed in 120 days according to the FBI congressional testimony, and the lengthy wait had caused emotional stress and financial loss to me. Sorry I couldn't post my letter, it had too much personal information. Anyway, I would suggest to read the following thread, especially posts from wonderfulboy between January 4 and January 15.

I got the response on 4/7/05 saying the name check was finally completed. I can't be sure whether it was my last letter or simply cumulative effects of all; or it's simply my turn. It doesn't really matter anyway. I wasn't going to send another letter cause I thought I had exhausted all of my options, I guess I was lucky it did finally generate a postive response.

some one posted in Nebraska 140 section that all the workers at NSC are attending a week long training program, I think even at CSC this training was done thats the reason we didn't see any approvals for last one week
 
That answers why there was not many postings/updates about the cases in this thread. Hope to hear lots of good news this week ...

My lawyer's interpretation of processing dates
The lawyer wrote -

"The CSC processing date indicates the date of cases that are being transferred from "the shelf" to a CIS Adjudicator. The cases are moved in batches and the processing time going forward will vary depending on where your file is in the stack and how quickly the adjudicator assigned to your case reviews his/her cases. Please give the CSC 90 days to make a decision on your adjustment applications now that the processing time report indicates they are working on applications filed prior to 12/16/04. ".

Hope her theory is correct and the wait is not too long for all of us.

Hi all and Unitednations:

I was informed today by my attorney that I got RFE regarding the previous experience letters. I need the help from you--gurus, please.

Questions:

Situation: On ETA 750, mentioned 2 year experience, I have 2-year part time (20 Hours) work experiences as graduate assistant while pursuing my master degree. When submitting LC, one staff from the university wrote a letter for 2 year experiences without day/month of starting and ending and hours per week, so I got LC approval. When submitting 140/485, my attorney did not submit this letter. I talked to him just now and he asked me to provide a letter from the university to attest I had 2-year part time experience with duty, title, dates and number of hours.
1. Can I ask some faculty of the university to write this letter?
2. Can 20-hour part-time experience as graduate assistant convince CIS?
3. I also had 5 year experience abroad, but on the ETA 750, I inserted the job title and did not include the duty related to my current job. Is this okay for me to request a letter from my previous employer abraod to attest my previous experiences even though not mentioned in ETA 750?
4. What the chance of the approval after responding to the RFE on this matter?
5. Any suggestions?
