i-134 Support question

I am getting ready to file my i-485 (EB2) as well as the derivative-485 for spouse.
I am on H1B and my spouse is on F1 visa and works as Research assistant for 20 hr/week.
I understand that i need to file I-134 as affidavit of support with spouse's derivative-485, but when i read I-134, it seems like only Us citizens/LPRs are supposed to file it when sponsoring someone.
What am i seeing wrong?

Gurus/Friends, please help.

Hi,

My attorney did not ask me to file I-134, instead they asked me to file I-864. Do I need to file I-134?

Thanks

Read the instruction on I-864. It clearly states tthat I-864 is for Family based cases. Other then that you need to file I-134.

Thanks number30, When I was looking into the website here is what I found out.

Who Needs an I-864?

Applicants for family-based immigrant visas, including orphans. (Self-petitioning widow/ers and battered spouses and children of U.S. citizens are exempt from this requirement.)

Applicants for employment-based immigrant visas where a relative filed the immigrant visa petition or has a 5 percent or greater ownership interest in the business that filed the petition.

I am really confused now.

Thanks for the Help Ginnu/friends,
I guess i'll fill i-134, have it notarized, attach a copy of the employment verification letter and enclose it with the spouse i-485.
Please correct me if anything else is needed.

------------------if your spouse is not working with YOUR employer then she dont need any employment verification letter from your employer.

Please correct me if anything else is needed.

Her passport pages with all the pages that have her name, Dob, Photo, visa stamps or entry stamps, Fee check, Copy her valid I-94(front and back), birth certificate, medicals, photographs ,form G-325A (better to file EAD AP with forms I-765, I-131 as Fee is going to increase)

I had the impression that I needed to get my I-864 forms (including I-864A) all notarized, but couldn't find it in the I-864 directions. In terms of affidavit support, does only the I-134 form need to be notarized and not I-864? I'm filing for my mother, so I'm pretty sure I need I-864 forms (I have to verify that).

Make sure you dont confuse the purpose of Notary.
In legal situations, if we (individuals) are filing for docs by ourselves then we need to Notarize to authenticate our signatures.

But, If the Attorney is doing the paperwork for you, then one would not require any notarization, as the paperwork goes in with the status of "Attorney Certified" rather than "unverified".

Just something that I learnt while talking to my attorney on various topics.

Well, did anybody have to get their I-864 forms notarized for the signatures? Otherwise, because of the trouble, I'm not planning to get them notarized, since it doesn't specify in the directions anymore. (I found the "notary public" directions in some older I-864 forms.)
