I have a couple of questions in filling the I-134 form.

9. That I have previously submitted affidavits of support the following persons. If none state none.

(Here I have entered my parents name and the dates due to their recent visits)

10. That I have submitted visa petitions to the immigration and naturalization servie o behalf of the following persons. If none, state none.

(Are they asking whether i filed GC visa for any other person other than my wife? or is this for travellers visa i have applied for my parents? What should i fill in ?)

Thanks

9. That I have previously submitted affidavits of support the following persons. If none state none.
Answer: Although I had filled for my in-laws who visited last year, I have left this blank since they have returned to india over 12 months back.

10. That I have submitted visa petitions to the immigration and naturalization servie o behalf of the following persons. If none, state none.
Answer: I have typed N/A which stands for "Not Applicable"

kd,
thanks for your reply. but that is only for your case......can you suggest what I need to fill in those columns?

i have filed an affidavit for my parents in march 2003 and they are with me now. Which means i need to enter their names for question 9.

For question 10 (have u submitted visa petitions in the INS.....?) I am confused whether to have my parents name there too or just say 'none'.

Any suggestions?

thanks

singarb:

answer 10: You should include names of each parent (other persons, if any)

answer 11: Only if you have filed visa petition then put names. I-134 is not a visa petition to the best of my knowledge (but you may want to clarify this!!!) . I-134 is a an affidavit of support which states that you will financial support the person named in the affidavit if and when they enter usa and till they are in usa.

I think based on what 'visa petition' means I can decide on what to fill in.

Does visa peitition mean

#1 GC application?
#2 Application for Visitors Visa
or both?

If it means just GC then I can fill 'None' in that column. IF not I have to enter their names in 10.

Visa petition means immigrant (GC) visa and non-immigrant (such as visitors) visa. So answer is visa petition means both!

That is where I am confused. Do we apply non-immigrant visitors visa through INS?

i might be wrong. But I need a second opinion in this regard.

Raju595,

can you help in what needs to be filled in question 10 of I-134? (in my case)

thanks.

only immigrant visa petition

i am of the understanding that it refers only to cases where you 'petitioned' for a beneficiary of an immigrant visa petition.

the letters of invitation sent to non-immigrant visitors do not count as visa petitions. the visitors self-petition for a B visa.

I concur with rohufish. this is also my impression.

you may want to send raju a private message so that he can respond to this! Keep us posted ... i regard his opinion too!

Forgive my ingnorance, but I was under the impression that I-134 form needs to be filled in by family-based GC applicants only?

However, reading thru this thread, looks like employment based GC applicants also need to fill up I-134 for their dependants (like wife and kids), is it?

I-864 is affidavit of support for family based visa

I-134 is affidavit of support for employment based visa

The answer to this item will be 'none' because you cannot
file for any visa by yourself. Only after becoming a citizen
one gets a right to file for an immigrant visa for immediate
relatives.

The non-immigrant visas as well as employment based immigrant
visas can only be filed by employers.

The answer once again is 'none' for this item.

You have not applied for the visitor's visa for your parents.
THEY have applied for it themselves, you may have only provided
an affidavit of support.

Excellent!! That sounds very logical too. I have filled the same in my form.

9. Names of my parents.

10. None.

Thanks for clarifying.
