I-134. Can i be a sponsor for DV winners?

Hello.

I have couple questions about I-134 form.
I'm working in one company together with my wife. We start job on 12 of August 2010. And we made ~12-13k till December 31, 2010. From January 1st we got full time and now I'm making an estimated ~24k/year and my wife is making 24k/year too (the same company, same position).
I want to be a sponsor for my 2 friends - DV lottery winners. I understand that my+my wife Current income is above poverty.

1st question:
- I derive an annual income of: I must put only my 24k here or 48k?
2nd question:
Signature of sponsor: I found somewhere in web, that if i'm married - both - me and my wife must sigh in full name. Is that correct?
3rd question:
If i must write 48k i must present 2 letters from employer about our position and all of our pay-stubs or only my alone?

You need to start by talking with your employer (or their personnel/HR/payroll office). You each need to obtain an official letter from your employer on their letterhead that states 1.) the date and nature of employment (when were you hired, and when did you change to full-time and the position), 2.) annual salary (or whatever they are willing to put down which could be the bi-weekly pay or even hourly rate and number of hours per week), and 3.) whether the position is permanent or temporary.

The answers that you enter on the form should match the supporting documentation.

To get an idea of the amount that qualifies depends on the household size and that includes the intending immigrant(s) even if he, she or they will not live with you (see the form I-864P for a rough guide). The I-134 is not as strict as the I-864 on income requirements but that is a good comparison and really all you've got to guide you.
 
I'm familiar with I-864, because i was a petitioner for my wife, but i was not in poverty at the time, so we was using joint sponsor.

I got a letters from my employer today and they are stating date when we start work, how much we make per hour and how much hours we work per week (50h). And that we get paid bi-weekly.

So i'm planning to fill out I-134 like this:

- I derive an annual income of $48.000.
And i will attach my employer letters, all my and my wife pay stubs, explanation letter how i counted my annual income, tax transcript for 2009 (even though it's only 4k..) and I still didn't fill out for 2010.

I still have one question how i must sign I-134. Only my full name + signature, or my wife should sign it too?
 
The I-134 is written in the first person, meaning that it is filled out by one person only. You can list your income and if your wife is also pledging her income in support then she needs to complete a seperate I-134.

Re-read the section of the I-134 instructions about "joint and several liability issues". It states there that the alien and the sponsors share the financial obligations while the form I-134 itself in item 8 allows you to be either wholly or partially responsible and item 11 allows you to spell out your individual contributions to the sponsored alien(s). You and your spouse can work out the details between the two of you as to how the DV winner and any dependents are satisfactorily provided for to satisfy the Consular Officer.
 
Ok now that is confusing... :confused:

I-134 is written in 1st person, so as i understand i can show only my income to support my friends.

I will be fine with only my income? As i understood i cannot show My+My Wife income... :confused: :confused: :confused:

The I-134 does not talk about a household or household size. It talks
only about persons who are wholly or partially dependent on you for
support. It's an important distinction in your case.


So my wife is not dependent on me, because we both have incomes.
 
Using the I-864P as a "rough guide" (not mandatory) for the I-134 you still meet the minimum based on yourself and the DV winner and spouse, that's great. The I-134 further allows you to list non-financial support, like a "temporary residence while they look for jobs and an affordable apartment" or something like that.

Your spouse can hold back and only be approached to file a second I-134 IF needed (probably won't be).
