I-131 Questions

I applied for my wife (I-130, I-131, I765, I-485) on October 1 and she had her fingerprints taken today. I was wondering about the advanced parole timeline (I-131):

1. Is it related to the finger print process or is it separate? How long does it take to get the AP documents? The USCIS website says 3 months .... but is it from the day of when they received the package ( Oct 1) or from the day of the finger print (Nov 19)?

2. Can you share your experience about the time between the finger print and the receipt of the AP documents?

We are trying to book our tickets to o overseas and we want to see if we can g before Christmas or not.
Any help would be appreciated.

thank you

It has nothing to do with her Biometrics appointment, it is completely separate process.

It should take 60-90 days from the Receipt Date on the I-131 receipt notice she received.

Make sure she did not overstay more than 180 days prior to applying for AOS, otherwise, if she leaves the country, even with AP she is trigering a 3 year ban from returning to the USA.

I am also waiting for I-131 approval. Receipt date October 4, 2007. Any I-131 approvals? I have tickets booked for Jan 14....

Getting Worried

Now ... I am starting to get worried, I can't even see the case status on my wife I-131 online and we have tickets in 10 days ..... I will them tomorrow. What about you guys?

Bad News

I have just finished talking to an INS officer after waiting on the phone for 1:45 minutes and after couple of transfers. He was extremely rude when I asked him to check the status of my I-131 since I can't see it online. He said that he can see its, so WHAT DO I WANT?!!!

I asked about the processing date and he said it 120 days from the day of notice and not the day of receipt and I should call after 120 days from that.
I thought it was 60-90 days from the "Receive date". But it is 120 days from the "Notice Date"

I mentioned that we have tickets to go on vacation to Europe for Christmas and he said so.....?!!!!

He said that I can only go to the local INS office to get the documents in the case of an emergency ....

Here is my experience ...

I think I had suggested that you make an Infopass appointment. You cannot sort this out on the phone and you will continue to get that response if you insist on calling the customer service number.

Make an Infopass Appointment and take your tickets and I-131 Receipts with you, it is now 21 days to Christmas.

Infopass appointment

I have actually listened to you, but the earliest INFOpass appointment I can take is 3 days before my flight.

I was wondering if you know ....... would the local office process it right away and give me the AP or would they want to mail it t me?

Also, when I made the appointment online, I have selected the option that say "You need information or other services ", does it matter?

i plan to go there and take 4 photos with me and the email confirming our reservation (everything is virtual ticket right now)

They should be able to process it right there and then and hand it to you before you leave but you must take with you your receipt notice and acceptable proof of travel.

I am assuming you have applied for AP at least 60 days ago.

And if your AP arrives in the mail before your appointment simply cancel your infopass online.

Just a reminder, that when you are seeking a benefit, you have to deal with the "requirements" even when they are waiting in despair and being threated rudely... :p

USCIS has no fault in your booking your tickets early.
