I-130 - Waiting too long - Need advices

Hello,

I (LPR) filed form I-130 for my wife (in Vietnam) on Jun-2002 at Texas Service Center. So far, I received only the Notice of Receive. I have heard that my case is only processed if the priority date becomes effective. When I check the priority date on INS website, it shows that the processing date for I-130 application is 11-01-2001 (for October 2005). However, when I check the processing date on Texas Service Center, it is March - 01 -2001.

So I just wonder which processing date will be applied for my case?

Is it normal for waiting too long to get the approval? Anybody has the same story?

It's normal if you are GC trying to sponsor you spouse. According to the website, they are still processing March 01, 2001. And you filed yours on June 2002. So you still have a long wait. Based on people experience in this forum the length of time for GC holders filing for their spouse is usually takes about 3-4 yrs.

You might want to call them to make sure they have your file if you worry about it.
 
Where do you see 2001? I just checked, and for marriage based I-130, they are working on cases marked March 28 2005!!! (in texas)
 
you right it's march 28,2005 if USC(citizen) filing I30 for spouse but in Lan & Thuy case, they are GC(Permanent Resident) filing I30 for spouse.

I have other questions about Finance Support: When will I have to submit it (Will I have to wait for INS' prompt?); and what criteria are applied?. I ask this question because I wonder if they require that I must have some specific income (and money in bank - which is OK if I as for help from my parents & relative). I have just finished my Master, and really want to go for a PhD, but I've heard that I must have a job with good salary, and this means I have to postpone my studying.

Can a student file a support in this case? (if I continue my studying, I am paid about $1,500/month by school).

You usually file the Finance Support (affidavit support:INS term) along with your I-30 but since you didn't do that you probably will get RFE (Request for Futher Evidence) from INS when they start processing your case.

To aswer your question, you need to meet 125% income above the pverty guidelines which you'll be able to find it in this link: http://uscis.gov/graphics/formsfee/forms/files/I-864p.pdf

If you make $1500/month that should meet the 125% I think. Make sure you provide or keep your paystubs and tax return for the last 3 yrs. But if you're not sure, you can have your parents or relative co-sponsor your spouse.

Here is what I found:
"A substitute sponsor is a sponsor who files an I-864 Affidavit of Support in place of a visa petitioner who has died. In order to be a “substitute sponsor,” you must be related to the intending immigrant in one of the following ways: spouse, parent, mother-in-law, father-in-law, sibling, child (if at least 18 years of age), son, daughter, son-in-law, daughter-in-law, sister-in-law, brother-in-law, grandparent, or grandchild. You must also be a U.S. citizen or national or an alien lawfully admitted for permanent residence, be at least 18 years of age, domiciled in the United States, and meet all of the financial requirements of a sponsor pursuant to INA 213A."
