I-130 waiting processing time?

Hi

I'm a USC. I filed I-130 for my husband on July 2005. The receipt I got back says they received my petition on July 14, 2005. We live in Arizona so I sent the forms to California Service Center. Six months later, on January 2006, it was processed according to the California Center processing times on the USCIS website. Still I haven't received any letter of confirmation or denial of my I-130. The status of the case online says it will take from 990 to 999 days to process. That's almost 3 years. How come if I'm a citizen?

My question is how much longer am I supposed to wait for an answer to my I-130?

CSC processing dates have passed your notice date. On this forum I have seen people who applied in Nov 2005 getting I130 approval from CSC in your category (immediate relative/spouse of USC).

You may want to call USCIS, schedule INFOPASS to see if you can find out more. Did you change your address since filing I130?

Why you did not file all together I-130 and AOS package all at the same time at Chicago Lockbox?

Immediate relative (spouses, parents and children under 21) of USC should apply concurrently I-130 and I-485 at Chicago Lockbox by Memo from 2004!

Sorry, by this time your husband long time ago should got his residency. If you have a receipt of your I-130, file the AOS at Chicago lockbox and attach the receipt of your I-130, I think you can do it like that as well. Will be easier and at least your husband does not need to wait any longer and be able to work. In any case, you can make an INFOPASS and verify if you can do it like that.

I am also from Arizona. It says 990 to 999 days for everyone. We got approval from Los Angeles in about 7 months.

Answer to cherr1980: We didn't file for the whole AOS package at once because we couldn't afford it all at once, given we're also filing for his daughter who is overseas. So instead of not filing until we could afford it, we filed for both I-130's first.

I called USCIS and to our surprise they said my husband I-130 was approved. 3 days later we got the receipt notice. Now we're going for the I-485 for him and his daughter. And yes, we can afford it now. I'm not sure how the process about his daughter being overseas works. That part is not clear to me. If anybody can give me a line about it I would appreciate it. Thanks.

Answer to sometime2006: No, he's in the states. We've been married for over a year now.
 
Also I-30 processing time

Hi, I was also upset before I read the posts. I got married in China March 24. I mailed off my I-130 papers on April 6 the day after I got back here to SC. I got my I-797 notice of action back on April 22. So today I was able to mail off my K-3 to Chicago, Illinois. I live in South Carolina so I had to mail the I-130 to the Texas Service Center, but when I get my I-797 notice of action back, it says that the California Service Center is doing it. Also when I seen the 990 to 999 days to process!! I flipped as I hear usually 6-10 months! While in China, I got someone to do all my paper work for us in filing packets and complete with everything ,pictures, legalized and translated also in Chinese. He showed me his last client was approved to come to the US in 6 months with her visa. I called USCIS today (04/24) about my case and they told me that it was sent to the California Service Center because it was faster than Texas?? Is that so? Also, any more info is welcome. I sure do not want to wait 3 years! Anyone that also needs any advice on what I had to go through to marry in China, I can help all I can. Anyway, I am very happy now as me and my new wife get along great and I am going back to China June 2 to stay with her 30 days. :) Good luck to everyone.

Answer to sometime2006: No, he's in the states. We've been married for over a year now.

On the I-130, you indicated whether your husband and his daughter would like to go through adjustment of status or consular processing by designating the district office and/or the overseas consulate.

If you indicated the CP, your I-130 would be forwarded to the National Visa Center and they will contact you for further action on the application. If you indicated AOS, then you should go ahead and file the I-485 packet with the approval notice of the I-130.

Were you not able to file the DCF in China?

(However, I am not sure if US Embassy would accept DCF or not. But i just wondered.)

Hi! I am not sure what DCF is. :eek: sorry. All I know is I was told this is the fastest way to go about it. Explain for me and I can find out for you.

I found out that you cannot file DCF (Direct Consular Filing) in China. They do not allow it.
 
Hello, I got married in China in Sept '05 and filed my I-130 in the U.S. Dec '05
Got a receipt date of Dec 31 '05
Was approved May 11 '06 and received the I-797 notice soon after
Now June 19 '06 and we are waiting to be contacted for the next step

Which service center did you file I130 with?

I believe you are going for Consular Processing. In that case USCIS svc center will forward you approved petition to NVC. You should be contacted by NVC regarding next step anytime now.

I filed with the Vermont Service Center. I'm in Maryland, but, my wife is still in China. Hopefully that next step will be soon :D
 
Both I-130 and I-129F approved at same time!

Another update:
August 15 Received letter from National Visa Center- Approved and mailing petition to China in Guangzhou

April 25,2006 Received I-129F at MSC
April 28,2006 (I-797C) Got notice of action
June 28, 2006 Request for more evidence (International Marriage Brocker Regulation Act as of January 5, 2006),, Everyone will get this now to fill out and sign and return it, 2 pages)
August 1, 2006 I-129F Case Approved

April 10, 2006 Received I-130 at CSC
April 18, 2006 (I-797)Got notice of action
July 31,2006 I-130 Case Approved

Next-- USCIS is now forwarding my approved case to National Visa Center.
UPDATE: August 15, 2006 Received letter from National Visa Center- Approved and mailing petition in 1 week to China in Guangzhou for my wife to receive packet on how to get K3 visa :D

Not sure how long it will be before I get the " Affidavit of Support" and "Choice of Address"?


I was very suprised all was approved so fast. Anyone else having theres approved this fast? Good luck and best wishes to all to all. :) Any idea from anyone how much longer before my Wife can come here? I am hoping no longer than 4-5 months? Ia m wanting to go back to China to stay with my wife again, but I am not sure when all this paper work will stop coming! haha

PS: This is for China, I live in South Carolina
