I-130 Upgrade

I have applied I-130 petition for my son last year, when I was a green card holder. Recently, I became a US Citizen and would like to update the I-130 petition. I searched the USCIS website but unable to find I-130 upgrade form. Could someone please direct me for the right procedure of how to update or upgrade the I-130 petition. My son who is 20 yrs old and will become 21 in Nov 2009. Thanks in advance for your inputs.
 
you have to call the uscis at 1800-375-5283 to update your status from GC holder to citizen. then they'll take it from there, Just have your receipt # at hand and related info

I'm in the same situation as you...i just became citizen last thursday...did you update your son's I-130 already?
 
Yes..I already sent the I-130 upgrade form with the copy of Naturalization Certficate to USCIS.

ok...so i need to write another I-130, a copy of my naturalization certificate, a letter asking to upgrade the case and send where? my son's case is in California center since July of 2007, but i hear that i need to send to the NVC. That is what is confusing me. :)
 
I sent the I-130 upgrade form with the copy of the naturalization certificate to USCIS California Service Center P.O. Box 30111, Laguna Niguel, CA 92607 and another one to texas service center where my son case has been filed in 2007. I think you need to send it to California service center where your son's case is, I am not sure for NVC, might someone knows on this forum and can give their inputs.
 
Congratulations! That was lightning fast processing. You have wrapped up everything in less than 3 months.

I think it was fast maybe because i don't have any major issues with the regulations they have. The past 7 years that i live here, i never receive a citation, never leave the country, same town, since i received my first employment card i work in the same place (but was promoted twice), paid the irs always on time with no issues,etc...the IO was very nice, he said my case was too easy :D

Send upgrade request to service center which approved I-130, Service center would in turn send to NVC

Ok, early this morning i called the USCIS, a very nice lady answer the call, i explained to her everything and i told her i was not sure where to send the copies to upgrade my son's case. She ask me for their case number and gave her my information, my certificate number and a lot of other things she asked for, then after she entered everything in their system, she told me the target date for both of my son's case was January 22, 2009 when an agent will be assigned to their case. She told me soon i will receive a confirmation letter with the receipt number (that she already gave me over the phone) and mentioning where do i need to send the copies of my naturalization certificate. As i know how difficult is to have someone answering the phone so i ask her about my older son situation, as he will be 21 year old in April of 2009, she said the case will be approved faster because they are still minor unmarried child of a US citizen and as soon as the NVC issues a visa number for them, they will be able to finish the process in Brazil and will be here with all of the documents they need. And i don't need to worry about the adjustment of status after they arrive here.
I'm crossing my fingers now.
 
I-130 upgraded

AFTER I GOT MY USC CERIFICATE (MARCH-17-2009) I CALLED USCIS AND ASKED THEM TO UPGRADE MY I-130 FOR MY WIFE (I-130 WAS FILED WHEN I WAS A GREEN CARD HOLDER - APR-13-2006). TODAY APR-1-2009 I RECIEVED A LETTER FROM USCIS SAYING THAT :........................

WE HAVE UPDATED YOUR I-130 THAT YOU ARE NOW USC. AS A RESULT, YOUR PETITION IS NOW IN A NEW VISA CATEGORY AS THE IMMEDIATE RELATIVE OF A USC AND IS IN ACTIVE PROCESSING. ........................

I CALLED THEM TODAY AGIAN AND ASKED AN IO THAT IF I NEED TO SEND MY USC CERTIFICATE TO THEM THE IO TOLD ME THAT I DON'T NEED TO DO ANYTHING NOW AND I WILL BE ASKED TO SEND IT WHEN MY I-130 GOT TRANSFERED TO NVC :rolleyes: . THE IO TOLD ME THAT ALL THE TIME THAT MY I-130 BEEN PENDING BEFORE MEANS NOTHING AND NOW MY PRIORITY DATE IS THE DATE THAT MY-130 GOT UPDATED (MARCH-21-2009) AND THE PROCESSING TIME FOR I-130 IN VERMONT CENTER IS 6 MONTHS.

I DON'T KNOW WHAT I SHOULD DO NOW. WAITNG ? SENDING MY USC CERTIFICATE TO USCIS ? OR ............??? ANY ADVICE ? PLEASE HELP

I was under the impression that the priority date for I-130 will be the original filed date which in your case is Apr 13 2006 after the upgrade?

Is that not the case with you? Do you have to wait for another 6 months just like a fresh application? I am going to be in a similar boat as I am awaiting my N-400 interview/oath.

Hi All. I'm in similar situation. I became US citizen on June 17th and called to upgrade I-130s for my wife and son on June 18th. I called USCIS yesterday to check on status of those applications and officer told me it will take as long as 6 months for USCIS to approve I-130s before they pass them to NVC, because of some new rules for background check. She told me that my wife and son will be able to come to US approximately next spring. This totally sucks, I've read on this forum that it took USCIS just 1-2 months to approve I-130 applications for other guys.
 
Where can I find the I-130 update form as my status has changed from a GreenCard holder to Citizen after I file for the initial I-130 form for my wife? I searched the USCIS website but wasn't able to find it.
So I only have to send in
1. I-130 update form
2. copy of my neutralization certificate
3. a letter explaining the change of my status
ANYTHING ELSE????
