I-130 upgrade????????

Hi Guys,

One quick question. I filed for adjustment of status in September with I485, I765, I693, I131, I864 and I864a as my wife became USC. I filed I130 in 2005 when i got married (She was greencard holder). I130 was approved in 2005. Now somebody told me that i have to send letter to Vermont to upgrade my I130 to get my interview. Please i need your advise regarding this.

would it be too much to ask to do a search on this forum with words "I-130" and "upgrade"?

Maybe I'm wrong, but from what I've read, you only need to send an upgrade request letter if you are doing consular processing. But if you are adjusting status, all you need to do is submit the 485 application with a copy of the approved I-130 and your spouse's naturalization certificate (copy also), and other required docs/forms.

That's what I did in August this year. I was on H1B from 2000 thru 2007, got married in 2004 when my husband was still a green card holder. Filed for I-130 in 2004 and was approved in 2007 (yes, it took them that long). He became a US citizen in August 2008 and all I did was filed the stuff I mentioned above.
