I am a spouse of a Green Card Holder.
I-130 is in progress (waiting for a free visa number).
I am living outside the US!

I want to buy a house with my husband in the US and therefore travel to Florida for one or two weeks. I read it is not allowed to enter the US during I-130 process!! Not even for a hort visit!?

i was asking my embassy here about that matter:
quote:
Seeking admission under the Visa Waiver Program (while married to a
"Green Card" holder, whether a petition for immigration has been filed
or not) is not prohibited either. However, you (as well as all Visa
Waiver Program travelers) have to convince the U.S. Immigration officer
at the port of entry that you are only coming for visitor's purposes.
Please note that the final determination about your application for
admission to the U.S. is always exclusively made by the U.S. Immigration
officer.
Sincerely,
Visa Unit
Consular Section

Now what?, the embassy says I am allowed and on the other side it is not
allowed to enter. Who has experience!! I know it can last up to 5 years to
get me my visa!!

can I fly over there and enter with my visa waiver and say to the IO that
I am just visiting or do I have to say I am in I-130 process and want to buy a house here and leave after that??

thanks for advice

You read incorrectly. Legally nothing is stopping you from making a short visit to the US. Having said that, it all depends on the POE officer's discretion if he/she grants you entry.
