I-130 Question

I got married three years ago. My wife is an Indian citizen and still in India completing her education. She has one year to go now and I am getting ready to file the I-130 Petition.


Does it matter that I have waited for three years before applying for I-130? My wife wanted to complete her education before moving to the US. Will this affect my case? Should I send a letter along with the I-130 stating the reason why I have waited this long?

I am assuming you are doing Consular Processing in India, Right? If so, you can file I-130 any time. As far as stating the reasons for waiting, others on this board can give you better insights. My personal opinion is that you dont have to, but she can have the necessary documentation prepared at the time of the interview.

Faire... no need to do that at all. If they ever ask her why (which I HIGHLY DOUBT THEY WOULD) she can just say she needed to finish school there. That's all there is to it.
One thing you might want to consider - since you are a US Citizen, she is considered an immediate relative. At this time, it takes about 6 months or less to get the immigrant visa. And the immigrant visa has 6-month validity. So, if she still needs to be in India for 1 more year, you might want to wait just a little longer.
You could also take your sweet time to submit the required docs once the application is at NVC, thus making sure there will be enough time before she is required to come to US.
