I-130 Processing Time After Removal Proceedings

hi everyone,

I would like to ask some help regarding my immigration situation. I married my first wife USC back in 2008 may. the marriage took about 4 months and I filed for divorce 'cause my wife was on drugs and alcohol. She had previously problems with alcohol and drugs but not while we were dating about 2 years prior our marriage. I had to file for divorce because she was way out of control and I couldn't handle anymore. We filed the papers for AOS but we never showed up at the interview because I already filed the divorce papers at court. The interview supposed to be held back in January of 2009. Because we didn't show up my AOS (I-485) was denied and I was put in removal proceedings around August of 2009. I got married with my 2nd wife in September of 2009 and we filed an I-130 in November of 2009 and a 2months later the Immigration Judge terminated the deportation. We had I-130 interview a year ago July of 2010. We were separated and interviewed about 30min each of us. After the interview the officer told us that everything is fine he just needs a few other things before he can approve I-130. we need to file tax return for 2009, 2 passport photos, and affidavit from the neighbors and friends that our marriage was entered in good faith. we sent the documents in 2 weeks. Since then we haven't received anything from immigration and had INFOPASS appointment but we haven't got any info. We live in Los Angeles and I work for myself and my driver's license is expired. my wife gives me a ride when she's not working or not in school. my question is what should we do in order to ask immigration to approve or do something with our case? do you guys think that it would be a good idea to send more supporting documents pictures, bills etc... And I have another question. when we were at our interview we got a paper from the immigration officer regarding the supporting documents he wanted us to submit. On this paper it says ISO and an officer name and SISO another officer name. What does ISO and SISO stands for? Were we interviewed by ISO or SISO? sorry about my english
 
I am in the same situation. so your saying you didn't get your I-130 approval letter after almost 2 years? How did you terminate the removal proceedings then? Did you use a lawyer? Or just told the judge that your filing everything again?
 
We hired a lawyer and came with us to court. He showed the judge that I-130 is filed and transferred to the local processing center (LA/California) and that is correct I haven't got my I-130 approval after almost 2 years. We really don't know how to proceed and my lawyer says that we just have to wait. Any help would be really appreciated...

Open a Service Request through USCIS' online service.
 
Did you have Stokes interview ??? If not you will have it. Everybody that is in ID procedings must have it.
I am in same boat. I just passed Sokes . Without stoke interview Judge will do nothing , Stokes interview is`when they separate you and than grill each of you after grilling they start to ask you questens.
Most important that Judge and IDA will ask is Stokes interviw and Finger prints.
If you have this two . Get Medical , and it ,to it vill cost $110 and in&out in one day .
Dont waist time to pay your laywer if you have not thos two aproved SI and FP.
if you have this than your laywer should ask IJ to lift Deportation and you are free after that .
If your attorney dont tell you this than he is leing ore is not good attorney.
I am suprised no body tolld you this. Any time I got in Icourt I get asked for new document. and I am married 4 years and have babygirl.
Now in some cases IJ could lift deportation, but you must go through interview and if you had and passed than you are free. Good luck hopping you get.:cool:

Before you go to Judge you need, to have this docs ore better adjourn it if you don't, cause you will be spending money on lawyers , and again you will have to go back. Dont ever go in Immigration court without attorney >you need attorny that tallk and make a scens, not somebody who seat get swet and say nothing .
Documents that you need to have are :

1-Prove that you filed for I-130
2-prove ---- //--------- 1-485
3-Electronic Finger /Printing (one finger only pointing finger right hand that is reported to IDA)
4-Complete Medical report that is not older than 12month one year.
5-Your Passport of your origin country with date of entry.
6-prove that you never being arrested (if yes need disposition of arrest ) if you being arrested for felony and spend some time in jail you are screwed get dam good lawyer.
If you were for traffic and is not felony than no big deal .As long as is not Felony .
7-If you have baby ore kid must have original birth certificate ,
7- Your wife must be present. I am saying must be present. If she can't go have good reason that right the way to judge.

If your marriage is based on love and family you dont have to worry,if not Your chances to pass interview are unknown Stock IO are wery well trained to detect any thing that is not wright.....If you get call for second time something is bed going on , but not that bad still is second time and could turn good , (good lawyer is must in stock interview)

One thing don't forget , many lawyers like to go in court as much as thay can, cause that's how they make money , If lawyer finish case in one shots than he is dam great , ore he/she is not rich at all.
My attornys new this but never tolld me , they just keep telling me " oh thats the law and made me pay any time they show up in court, and in one day they have 2-4 clients " insted to tell me what I need ore they should be prepared.

If you have all this documents and pass in stock interview ,honorable judge will close your case ,ore lift deportation . GC will be waiting in 4 weeks .

Why and how I know this ?? Cause I am in Immigration system for 23 years, while I was in political asylum waiting from supreme Court, in same time I got married to USC , Supreme court send me back to same Immig judge .When I went back in court , Honorable judge dismissed my P asylum case and send me to have stock interview. I passed my stock interview with flying colors my interview was only 15 minutes and my wife's was only few. Two days latter I received letter saying that I passed .
By the way Immigration court in New York NY , Texas and California are most difficult , Good luck to all of us.:cool:

We did have the STOKES Interview! The Immigration Officer told us that it's fine and requested additional documents which we sent it in 2 weeks. The Immigration Judge TERMINATED my removal proceeding before the STOKES interview while I-130 was pending. Now after the interview more than 1 year is still waiting for I-130 approval. Please read my first post. Thanks for Your help.
 
Bassman: if the old case is pending with bia, do they have jurisdiction to terminate proceedings or the case will be remanded to the court?
 
BIA have juristicsion :
To DENIE case. You have 30 days to appeal to Federal court,After filing you can get EAD.
To REMAND case to same court and same IJudge.9Start from scratch)
To TERMINATE IJudges desision. (terminate order od deportation)


Good luck I waited 11 years bet BIA and Federal court , and spend $32,000. I t was difficulte cause did not speak languge , no internet , and attornie scared of licing chit out of me. But now I know language , and dont listen what lawyer say at all I hired them and they will listen to me. all do respect there are many god attorneys out there and you could tell righ the way good one from badone.

Andewl ,dont worry , better like this for now . Time passes (2 years) and you will have unconditional GC... You dont want to look like desperate , you are married for love , you are here with your family , who cares for GC. Let them think like that.
 
Update: We had a second interview in October 2012 and I was granted permanent residency (Green Card). :D We are very happy and I would like to thank this forum for all the help. I wish everyone who are in the same situation like I was that never never never give up and believe in Yourself and believe in Your spouse. We are very happy and thanks again!

Help

i came with student(J1) visa and i applied tourist visa . i got answer after 8 months. 06/16/2008-06/17/2008( they gave me just 1 day visa which is weird)
i waited 4 months and i applied again tourist visa and i got letter from immigration 4/16/2009 but visa says(02/16/2009). which is already expired visa. they sent me expired visa which is totally weird.
after that i applied again student visa and they denied and they put me removal proceeding. that time i was dating with american girl. i had court march 17 2011 and i got married march 16 2011. after that i went to court and judge let me to applied green card. then

i applied i-130 and 1-485 and i got denied. i appealed BIA and they dismissed my appealed file and they let me to reapply
i applied second time and immigration denied again with small reasons. and immigration tells me that you need to submit l-485 to immigration Judge.

i need help i dont know what to do. how can i submit document with denied I-130? what judge decide with denied paper?
