Hi...my name is Edi.....I am from Belgrade....and I am new here........
My aunt is a US citizen....and 9 years ago she fill I 130 petition for my mother (and she gave all data for my father,sister and me).....two days ago....the petition was approved......my question is.........What will happened in next several months....and Does my father(60), sister(19) and me(22) have to wait another 9 years......or maybe we will get papers automatic.........or What????

This is part of I 130 :

1. If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative. You may file a Form I-130 for:
A. Your husband or wife;
B. Your unmarried child under age 21;
C. Your unmarried son or daughter age 21 or older;
D. Your married son or daughter of any age; E. Your brother(s) or sister(s) (you must be age 21 or older); F. Your mother or father (you must be age 21 or older).

2. If your relative qualifies under paragraph 1(C), 1(D), or 1(E) above, separate petitions are not required for his or her husband or wife or unmarried children under 21 years of age.

When exactly did she file? The priority date now is Feb 22, 1999, so most probably your family will have to wait for about another year for green card. In this case your mom and dad will get it, as for you and your sister... If your sister will be under 21 year old she's good too. But if she'll be over 21 years old - I'm not very positive, because not sure Child Act kicks in or not (same for you too). The Child Act (when the age gets frozen) is very confusing, frankly. I'm afraid you may not be even on list, because I-130 was approved after you turned 21. Lets see, may be someone with more knowledge about that law will come up and clarify...

thanks

I know....we have immigration layer in Chicago.....and when my aunt put documents in June 2001. he said that he knows how to do faster....so my moms petition is approved....we were very excited.......my sister is now 19.....and i am 22 and 7 days:eek::eek:.........So if i understand you.....my mother,father and sister will get papers for US...and it will be problems for me....right?????

Sorry for bothering...i am not very inform.....

Do you know when the I-130 was approved? The length of time it took to get approved is used in the CSPA formula that determines whether you retain eligibility after turning 21. Basically, you take the length of time it took for the I-130 to get approved, and subtract it from your actual age to get the CSPA-adjusted age.

thx

3 days ago.....

did you mean:

September 2009- June 2001 = 8 years

I am now.....22........so..........22-8=14

right????

It was just approved 3 days ago? Or it was approved long ago but you just knew about it 3 days ago?

That's the idea. They also count the number of days, not just years, so you would subtract 8 years and about 3 months, which would make your adjusted age be about 13 years 9 months right now.

For final processing of sibling green cards they are at Feb 1999 for all countries except Mexico and the Philippines, so it's probably another 2-3 years to reach Sep. 2001. By that time your adjusted age would be somewhere around 15 or 16.

However, if you were born in Mexico or the Philippines, you'll have a much longer wait (they are at Sep 95 and Oct. 86 respectively).
