I-130 Moved from NSC to CSC

Hi,

My I-130, with a receipt date of August 17, 2004, was moved in March from the Nebraska Service Center to the California Service Center (CSC). I was told that this was done to remove the backlog.

Today, I got a notice from CSC saying that the receipt date on my I-130 is May 2, 2006! Further, this type of applications is taking CSC about 990 to 999 days to process.

Has the clock been reset during the move from NSC to CSC, and have those 1.5 years that I spent waiting totally gone to waste? CSC will treat this like a newly filed application??

Is there anything at all I can do to expedite the process? I don't have 990 days left on my H-1B.
 
I really hope that they haven't reset the priority dates because that would mean death to a lot of people. I'm not sure about your questions, I'm just stating my opinions. I've been waiting for 3 and a half years on my i-130.

Honestly, I don't see how it's speeding the process up. For one, my case was in the Nebraska Service Center for nearly 3 and a about 3/4ths of a year till they transfered it to the Cali service center. So, think, it would have most likely taken you that long to get your petition approved. Now, they're listening a date of January 05 as the date of cases they're working on. That would make it a year and a half for you to get up to your date, going by how slow they process, and add that on to the already nearly 2 years that you've been waiting and I don't think there's that much of a speed up.

I may be wrong though, I'm not sure how quick Cali progresses. But if it goes at the same normal rate, I don't think it makes much of a difference getting it transfered.

"Current Status:

On May 3, 2006, your I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was received here for processing. It is taking between 990 and 999 days for us to process this kind of case. We will mail you a decision as soon as processing is complete."

So, I am guessing my receipt date is now May 3, 2006. The receipt date for my Nebraska Service Center notice was August 17, 2005!

When your application was moved from NSC to California, did you get something similar? Did your receipt date change??

You're right in wondering whether the process has sped up or not ...
 
No, I don't think that your receipt date has been or should be moved. By them saying that it was received there, they just mean that it was received from the move.. I'm pretty sure, hope for your sake that they didn't move your RD.

I just checked the notice of action of move that they sent me and it list my receipt date as the original date on my first notice of action. Re-check the notice of action that they sent you and see if your receipt date was moved.

Hey, I've also checked the status of my case online and it gave me the same kind of run around that you received. I'm not sure if all this time that I've waited means jack shit now. If they're going to change our processing dates and make our new receipt date when they received our change of location, then yeah, the whole time that we've waited means absolutely nothing.

I'm not sure what the new processing dates are for people like you and me. I'm planning on calling USCIS on Monday, or hopefully we can get a definite answer from someone on here.
 
got similar letter myself. called and i was in a hurry and it was late, but they now have machines answering the calls and telling you what the letter says. will try next week and call them to see what is the deal.

it might also be like airlines that add time to the flight so they can say they are always on time. immigration perhaps don't to say in 180 days because they know it could take longer and they will hear from people on the 181st day. still, if the figures hold up, we are talking 2 1/2 years. that is just crazy.

amnesty or no amnesty, it is critical that some bill becomes law so they can deal with the backlogs.

These are the i-130 processing dayes for the California Service Center, guys.

Permenant Resident filing for spouse or child under 21: January 1st, 2005 receipt date
Permenant Resident filing for unmarried child over 21: Febuary 7th, 2005 receipt date

What in the hell does this mean for us?

Like I said, my petition receipt was way back in september of 2002. The last time that I checked the Nebraska Service Center's processing times, they were doing dates at middle of 2002, so I was thinking that my case would be getting processed soon. Now my case is moved. I don't understand why my case would be moved to speed things up if they're going to change my receipt date and make me wait till they reach the processing date of march of 2006.

I may have been better at keeping me at the Nebraska Service Center.
 
as you can tell by the dates, CA appears to be faster. so even two years in CA might be better than two months in NE. and perhaps the CA center will do it faster and in months things could be done.

better question now is the CA center's speed when files are trans.
 
I am on the same page with you. My petition was in Nebraska since April 2003, on April 1st 2006 they transferred it to California. California never sent me any letter saying how long it will take, but I had an e-mail from INS saying that it will take 999 days. Is not it crazy? I have been waitnig since 2003 and now 999 days more? But I think they will keep our priority dates, they just can't do it to us.
Do you have priority date on your receipt? I don't. I see on mine only receipt day which is April 2003 and notice date - April 2006.
But also after that I went to lawer and she will take care of my case, and she didn't tell anything about new prioroty date. So I assume we still have priority date April 2003.

For what it's worth, my case was transferred in March to the CSC from the NSC. My PD is/was June 2002. As a son of a LPR.

I got the CSC notice saying 999 days or whatever it was at the end of April. I did manage to get in touch with a live agent there and she said that the PD remains the same, June 2002.

I just received a RFE from them. So I think this transfer sped up my case.

I don't think from everything I have gathered that they are resetting priority dates. I just think they are shifting all I130 apps to CSC. I think priority dates will remain unaffected and it may even speed up the process.
 
I also had I-130 receipt date of Sept 2002, and my case was moved over to CSC. Sometime back I read somewhere that they (USCIS) are not going to pass I-130 for NBC until 6 month before Visa number gets available. My priority date is stuck at March 1,2002. So, it is my understanding is that we need to worry about Visa Priority dates in respective categoty need to move quicker rather than we worrying about I-130 priority dates.
 
Visa# for my category get stuck on March 2002 and my priority date April 2003, another words I have a lot of time. It's sad, if only I knew how to speed up the process.

Guy, if your priority date is in March of '02 then it's now current!! :eek:

Lets hope for you and my sake that it doesn't retrogress. Well, I think that we should be attentive to if our i-130 petitions have been processed yet. Because if they haven't yet been processed, then we can't file i-485 until it is. So, we need to know exactly if the transfer of our cases to California Service Center, and the processing date of i-130 petitions with the date of January 2005, means that our cases that are now at California Service Center that have a later receipt date than the ones that Califonia Service Center is processing, are now processed due to the facts.

One other question: you stated that your priority date was march of 02, so that's the date that your petition was filed and mailed in ?
 
Guys, I recently talked to a Lawyer via chat on Lawyers.com and he himself did not seem sure about the times that we are looking at for our petitions to be processed, so I'm going to place a call to USCIS to clarify this situation, then I'll let you guys know what I found out.

Mumbai, I think that we can look at the bright side of things. Cali looks to be quick, and the priority dates on i-130 2a are creeping up there from when our petitions were filed.

Applications are moved back to Nebraska Center

Hey Guys,
I just called USCIS and they told me that all the applications for I130 were moved back to Nebraska center from California.

I'm in a similar situation as most of you are. My petition date at Nebraska center was July 2002, and I received a letter saying that my application was moved to Cali in March 2006, and the new receipt date is April 2006. I'm very frustruated with the response I just received from USCIS because the files are moved back to Nebraska and there is no information on their (Nebraska center) processing date on USCIS website. I asked the guy to give me a contact number for Nebraska center and he said that we can't call there but we have to send a written notice to find out the processing dates at that center. Please, let me know if any of you have any updates on this issue. Thanks.
 
That makes absolutely no sense. What was the purpose of transfering them in the first place? and how many peoples cases are being moved back?

This is not a joke! You can call them urself and ask if you would like to...I didn't ask him how many peoples applications were moved back, but I did ask him the reason why they were moving back, and what was the point of moving them to Cali, but in response he said that decision was from the administration, and he doesn't know why they are moving them back. I had called them two weeks back I guess, and at that point my application was still there in Cali, so this transfer has taken place withing this two weeks of period. You can call and ask whether your application has also been moved?? Let me know wats the outcome. thanks.
 
Well,you know what.. I don't really think it matters too much. By the time that I'm able to file for adjustment of status, my petition would have already been processed. So, I'm not going to call them.
