I-130, I-485 etc... the usual but bit of a mess !!

ok.... i got married to us citizen on the VWP after being here for 2 months in 06... we filed an I-130 shortly after with the USCIS and it got approved i have the reciept, then the rest of stuff we filed through the national visa center over time ( yes we know thats wrong now, i dont know how my wife got the idea we were spose to do it with them ) . after a lot of time and money wasted we find out we're suppose to file here with the USCIS so now after finding all this out and having to save up the thousand dollars for the right papers we're back at almost square 1 again apart from the I-130 obviously.

so now its a couple years later after getting the approved I-130, should i file a new one with the 485 medical exam stuff, and work permit application etc all in one ? or just file the rest and send the reciept for the already approved one ?


( and if anyone wants to threadcrap about overstaying after being married and not filing all the right papers together then leave it out, the USCIS have known exactly where i am all this time and have my last 3 addresses here with my wife that she notified them about, they would say something if they cared )

Why they should care is beyond me. So that when you walk into Target you lift an item as nobody seen?

You do not need to file a new 130. A copy of approval is enough. Also you may not travel abroad before getting a proof of green card approval, even if they issue you an AP.
 
Overstaying is not an issue for Immediate Relatives Category ( Spouse , parents ...). Please use the I-130 Approval to file the I-485 and attached documentation to the USCIS Chicago Lockbox.
