Entered US as canadian resident in 2000.My husband(P.R) applied for my I_130 in jan 2001 at TX service centre,which has not been approved yet though visa number is available since may 2005.The case was transferred to California in june for faster processing for which we received a RFE specifying nothing in particular so we sent a copy of the original application and documents.They received it on 6th sept 2005 since then we heard nothing so in dec called INS and they took for inquiry heard nothing for a month so made another inquiry in jan 2006 yet nothing ,meanwhile also contacted congressman who replied that the case is with an adjudicating officer and cannot do anything now,we need to wait till march.

We moved to MD in nov 2004 and asked the case to be transferred to VSC but INS said it cannot be transferred. MY husband applied for citizenship in march 2005 and had interview in aug and still waiting for an oath.As spouse of greencard holder cannot apply for adjustment or EAD (need to join a medical residency program in june)until I-130 is approved. anyone who had similar experience or knows a way to deal with this.Thanx.

You need to speak to an attorney about how to move your husband's naturalization forward. It may require having the case transferred to Federal District Court.
 
thanx for ur reply. we recently consulted a lawyer and looking at the citizenship application he found some loopholes and advised not to go to court,if we do so INS then looks at the file with a teethed comb and may throw the books on you(deny the citizenship app.) ,may even revoke the greencard.so as for now we decided to wait.
