I am a US citizen. I got married to non US Citizen who is outside of the United States. I filed I130 three and a half month ago, I still have not heard from the INS on the status of my application. I sent 2 letters to find out the status and got no reply. Can anyone tell me how long would I wait and what can I do.

Thank you

African hubby from Middle Eastern area

I was lied to by immigration regarding finace visa vs. being married. We married according to them telling us marriage would get him here faster. NOT true! But too late. Now, can we still use the K-3 finace visa even though already married? We are newlyweds and our lives are very much in upset being apart.
I am an American born citizen.
Also, regarding HIS G-325 bio-graphic form: Can I sign in his place using my own signature? Sending this to him and waiting for him to sign and return will put us another month behind in filing an already long process.
Also, is it advisable to obtain a lawyer to do the filing and have to suffer those harsh costs along with the filing fees and visa costs?
Thank you in advance for any and all responses.

approval after 10 months

i recived the approval of the I-130 until 10 months and then they processed it to the nvc. still waiting for papers and it\'s now a year. i submitted in oct.00 and approval was july.01. don\'t think yours will be any shorter.

I\'m sorry to hear that you were lied to by immigration. I know it can certainly feel that way. It\'s not faster, but if it\'s any easier, it\'s not necessarily slower either. I will attempt to answer your questions if I can according to what I have learned in this whole process.
First of all, you need to file an I-130 with the paper work that proves that you were married, your birth certificate, pictures (1 of you and 1 of your husband)specific from the instructions and of course the G-325 biographic info forms: (4copies for you and 4 copies for your husband) It does need to be his signature and the signature on each need to be the original signature (in other words, you cannot fill out one page, sign it and then make copies) I know it is horrible to be separated from our loved ones. I am experiencing that now. I don\'t know when I will get to see my husband, but I have decided I want to do everything exactly the way they are asking because I don\'t want to delay this process in any way. So, I wish the best for you and your husband and be encouraged that some day soon you will be with the one you are in love with. God\'s blessings.
