I-130 but not concurrent I-485?

hi hello,

i was hoping someone could help me clarify the "concurrent" filing term.

my usc wife and i filed the i-130 earllier this december. i have since found out that you can file different forms at the same time, to make it a "concurrent" filing. we obviously have not gotten a verdict yet in our -130 case. if i now sent in my i-485, would that still be considered a concurrnet filing or will it get rejected because i have not been assigned a visa number...or alien reg number?

thanks a lot, and happy new year with lots of good luck to all of you applying!

look at my history. I did not file concurrently, and I-130 was approved first, and I-485 was approved during the interview. No problem at all. You do not need to wait until your I-130 is approved to file I-485. You can file I-485 at any time, since your spouse is USC.

Since you don't have the approval for I-130 yet, make sure to include a copy of I-130 you already filed.
