I-130 - Bringing Disabled Brother to Usa with my parents. How ?

Hi Everybody,

I recently became citizen and now I would like to bring my parents and my brother to USA.

The problem comes as my oldest brother who is 40 years old and is mentally retarded and dependent on my parents.

Now if I apply for my parents and my brother, my parents will get approval much earlier than my brother. Now my brother can't stay alone and needs to travel with my parent.

What can I do to bring my parents and my brother all together ?

I have a very similar situation. I filed my I-130 petitions for both of my parents, and for my brother. My brother is a special child but is capable of taking care of our sick mother who had a stroke. My mom and brother are like each other's shadow and inseparable. Both of my parents' petitions have been approved and sent to NVC. I am doing research on other ways to expedite the processing time of my I-130 petition for my brother.

If anyone out there who can provide information, please do so. Thanks in advance.

You brother is likely to spend 10 years awaiting a visa. Unfortunately, since he's your mother's shadow, his shadown won't be allowed into the US until a visa number becomes available, so his shadow is going to be forced to stay home...:)

Expediting his I-130 won't speed things up. Even if they approve his I-130 yesterday, he still has to wait for a visa number in the 4th preference category, and that wait is 10 or more years since the I-130 was filed.
 
There are many other "special" cases. He and you will jsut have to wait your turn in a very long line.

I also believe that you will have a hard time proving that he would not become a public charge - especially after your mother dies.
