Hello,
Here is the situation.Spouse of (USC)
I-130/I-485/I765 was applied concurrently in April 2004.
Recieved all receipt and also had fingerprinting for I-485/I765.( already expired now).
Received I-765 after 8 months this January.

No RFE or address changed during the process.

A couple of day back after writing to Lee's Summit to inquire about I-485 a letter was received stating I-130 was approved and the benficiary is eligible to apply for I-485.????

This doesn't make sense because I-485 and I-130 is adjudicated concurrently for spouse of USC during the interview. Also I haven't seen anyone receiving just I-130 approval while I-130/i-485 was filed concurrently.

Since I-485 was applied with I-130 why would the letter state that beneficiary is eligible to apply for I-475?

Customer service or DO cannot give any information regarding I-485 status. Onlie status remains the same as pending I-485 application.

What can be done and what are the options?

Any help will be greatly appreciated
thank you

Hello ZoomZoom,

This the standard practice. The letter of approval you received is a standard letter used to notify the sponser(usc) that i-130 is approved. It has no bearing on I-485.

For i-485 either you will have another interview or if you already had an interview a notice will be mailed within a month or so. That notice will tell u whether I-485 was approved or denied.

best of luck
