I-130 Approved , can AOS be filed before visa dates are current?

My Mother filed for F3 (india) petition and I-130 got approved with PD Feb'04. Now I am in US on H4 with my family. Can we apply for AOS/I-485 ? Fyi...the current visa dates for F3 (India) are May'01.

Will this change of status make any favourable impact on getting our F3 petition ? faster processing etc?? Pls advise

No. You cannot file the I-485 until the PD is current.

Thanks RealCanadian, I thought so but then I thought maybe there is a way to get AOS/EAD
