I-130 approved, but not in the country, what now?

Hello everybody,

I think this is a quick/easy question for all you experts out there.. I filed for my mom the I-130 and I-485 concurrently, and her I-130 just got approved.

My question is she is traveling outside the country (using the advance parole document) and can not return to United States until end of September (2 months from now), is this a problem? I remember someone telling me that once petition is approved, you only have 30 days to report to interview. Is this true?

At the same time, I also filed for my dad, he is traveling with my mom using his advance parole document. But his I-130 has not been approved. I'd prefer to wait until both are approved before they return to the country. Is this a valid reason to delay my mom's return?

Thank you in advance for your advise.

is there an interview appointed? if not, then what interview is she supposed to report to?

second, are you sure it's just I-130 that was approved? not I-485? if just I-130, nothing to worry about, but if I-485 - then she became a US resident, and she may have a difficult time reentering, but it has happened before.

Seeing how parents' petitions are approved within months and without interviews nowadays, it's safer to stay in the US.

Hi LucyMo.

Thank you for your reply.

Actually, I might be jumping the gun a bit, i went to the USCIS case website, and both the I130 and I485 shows that the status was updated today, but only the I130 case says it has been approved. The wording for I485 hasn't change. At this time, I am not certain if i485 is approved. She is currently abroad, I am a bit worry since you mention that she might have difficulty re-entering. I hope the advance parole document is sufficient when she comes back.

I guess the best is for me to wait for the actual letter notice.

Hopefully AOS interview won't be scheduled too quickly.

theoretically, it should be enough, but I cannot tell you with certainty.

a lot of parents now are approved without an interview. Seeing how your I-130 filed CONCURRENTLY got approved, I think it's safe to assume that I-485 will be approved without an interview.

Hi LucyMo,

I got my mom's greencard today. As I mentioned before, she is currently out of the country. She has the AP document before she left. My question is, can she re-enter using the greencard? or should she use the AP document? Will they give her trouble if she use the Greencard to re-enter?

Thanks.
