I-130 approval notice question

Hi all,

I just received this I-130 approval notice for my wife in the mail today. The case was filed back in early 2004 at TX center but the letter (approval notice) was generated from CA center. Now, how long does she have before she gets her GC & become a perm resident.

Secondly, if all goes well I should God willing become a citizen too in about a months time, In that case I can send a copy of this approval notice along with 485 form & other required documents, isn't it. If I do that, how much time frame we're looking at for her to get her GC.

B4 I forget, I live in Atlanta, GA.

Please respond back.

Thanks a bunch.

since she can't even apply for AOS yet, it's hard to tell when she will get her GC.

yes

several months, if she doesn't get stuck in a name check.

News to me

I didn't know that females get stuck in name check as well. Wow.....that's a news to me. I know 3 friends of mine and their wives got their GC in 90 days or less, keeping in mind they had filed I-130 too, but if in my case I-130 is already approved, I was assuming that the process would go slightly faster.

Hi, I just want to ask about this name check thing...is this the FBI name check? How come some people get stuck and some people don't if it's the same organization (FBI) doing the check? I don't understand it. I heard a lot of people getting stuck in name check so when we went in for our interview I expected them to say we're "pending name check" but the IO said our name check was done. I'm not complaining, I just think it's soo unfair for the people who are waiting on name checks.

There are many threads covering this topic.

The short version is that initially namecheck is an automated system. If your combination of names passes through that without hitting a flag, you are cleared to proceed. If not, your case is referred for manual processing, which obviously takes much much longer, especially in view of the massive backlog and under-staffing.

I believe the official FBI statistics show that 90% of names pass the automated system, while the remaining 10% incur delays ranging from 6 months to several years or more.

Oh...thank you, that makes a lot of sense now! I used to think it seemed unfair, but the automatic and manual thing explains it...wow, I learned something new today! Thanks!:D
