I-129 Application Process

Hi All,

I am currently working on TN and still have a year of validity left on current TN with Company A. I have got a new job from company B. I have some questions which I am confused about as I have never applied via I-129 by the company.

1. If my company B apply for I-129 ( for 3 years) to be approved concurrently with company A, how does the process work. Do i still have to go to the border after approval of I-129.
2. Do I have to attend the interview for I-129 approval?
3. In case TN for company B does not get approved, do I still maintain company A TN?

1. No travel to the border is required if your I-129 is approved for company B.
2. No interview is needed.
3. Yes, you can keep your existing TN (and continue working for your company A) in case your new TN for company B is denied.
 
make sure the I-129 requests New concurrent employment otherwise you are expected to leave Company A as soon as the new I-129 is approved, which may not be your intention, but may be the expectation of the new employer.
